Hi Culinan,

I'm posting this here, because of the furlough/ Covid 19 thread, so hopefully not fringing on the rules.
With the new furlough rules saying that governments will publish the companies on .gov.uk, which is fine, but if I have accessed furlough for the two members of staff( I have 4 in total) that I won't be using to qualify for my 2 jobs and my company name shows up ( I've just checked, it does show) but what happens if HO looks at it and sees that but I don't have a cover letter to explain I used furlough but not for the two job roles that are part of my application, what could be the consequences? Have you had any cases like this come up?

Congrats on getting the ILR!
How long had you accessed furlough for and did you provide a cover letter explaining this in your ILR application?
Did your payslips show the normal 100% salary but you just took the 80% from the government to cover their salaries?

@Cullinan, hi, I have a question, I am on Tier 1 ent pre ilr, do you have an idea if there is an issue with HO if I have many ltd companies that I have but aren't anything to do with the visa one. Do I need to declare this and explain the other businesses I have and what they do? They have nothing to do with the original investment or the business I am on for the visa. I had opened them over the years for my own other work and businesses I have set up. Any thoughts on this?

Just declare the business you are claiming points for. Other companies are irrelevant for visa purpose.

Hello,

I am due to apply for my ILR in Novemeber.
Following the guidelines:
The 12 month period they are required to employ someone for can be made up of multiple jobs across different months, providing when combined this is equivalent to 2 full time jobs.
Time when their employees were furloughed under the UK Government scheme will count towards the 12 month period if they have been paid at least 80% of their normal salary.


I have 2 questions,
1. One of my staffs has worked for 15months and the other staff for 9months. The staff that has worked 9months has just notified me she will leaving month end for personal reasons. I was wondering if the 2 jobs witin thesame role (15months and 9months) can add up to account for the 24month period required for both staffs?

2. I have forloughed one of the staffs for 4months and paid her 80% furloughed 80%wage only. I didnt add 20% as they were not working during the first lock down. would this 4 months period count as a part of her 12month full time job.

Hi ,

i am due to ILR in few days , i just wanted to ask i have created two jobs

1- full time and 2 part time jobs will be combined to complete the job creation requriement

the 2 part time jobs , 1 employee was furloughed for 8 months when there was a lockdown i have question regarding her Wage rate my employee was less then 18 years old and at the time of furlough we have claimed her 80 percent wages according the her age when she was 17 years old but she turned 18 but my accountant said we will be claiming salary on her old wage rate when she was 17 my question is does it will count towards her 80 percent wage as it was claimed by CJRS as her wage rate according to 18 years should be more if it is more i will revise the rti and pay her the diffrence your feedback will be appreicated
