Tier 1 Ent. Dependent Spouse 180 days Absence

Hi All

My wife is on tier 1 Entreprenuer dependent visa her timeline is as follow:

Initial visa granted on 4th September 2015, Extension granted on 12th January 2018, and last extension granted on 17th January 2020 for 3 years till January 2023.

My question is, she is eligible for ILR in September 2020 but we are planning to go out of country for more than 6 months. So will she be still eligible for ILR when we come back after 6-months, as she will be absent for more than 180 days from UK.

Secondly if she won't be eligible after 6-months absence from UK then does she need 6 months more to complete her 5-years or does her clock time start from 0 to complete 5 years.?

Hope you guys Understand, what Im trying to ask. :)

A 6 month absence breaks her residence and resets her clock.

I suggest you think about what is important.

Actually I have some family Prob back home, and it will take more than 6 months to solve.

Will it be same Tier 1 Ent Dependent PBS Extension , she has to apply, after her current visa expire on 2023..? As I will have British Passport by then..

She will have to continue extending her pbs dependent visa until she meets the requirements for ilr. This is regardless of you becoming British. There is no shortcut simply because you become British.

It is important to note here that Tier 1E visa does NOT have an absence limit. The absence limit applies ONLY if you want to apply for ILR
