Hi Marcnath & Senior Member,

I have a some question regarding My issue.

1. Suppose my AR is not successful then can I apply for Tier 2 General ( Work Permit) for leave to remain?
2. If i get Tier 2 general visa then am i eligible to apply on my 10 years route?

Yes to both - of course, it is dependant on you finding a suitable sponsor and meeting other conditions of the visa application

Hi Marcnath & All Senior Members,

I have applied for AR within 14 days and now waiting for decision.I hope i will get through AR. I have question here.

If my AR is not Successful then i can Apply for 2nd Fresh Extension Application. My 10 years Residency will be due in March-2019. By that time, if i will not get my decision for 2nd fresh application can i very my application on 10 years residency? or i have to wait for my outcome then i can apply for long residency route?

Officially, I think you have to wait for the approval because you will be an overstayer once the AR is rejected. However, others in this forum in the similar circumstance have reported they were successful with varying a second application. So, if the need arises, you will have to try and see for yourself.

Hi Marcnath

I have Applied for my admin review on 10th April 2018. Admin review team sent me email that they will take decision by 23rd May 2018 but I haven't heard anything from them yet. No email no decision letter.

Can you suggest what to do now? Shell i write an email to Admin Review Team or wait to hear back from them?

Please suggest me.

Hi All,

My AR refused after 3 month and i have given 14 days for new application. I applied for Fresh Application within 14 days and submitted bio metric for fresh application.
After AR Refusal my Section 3C Ends and i am over stayer now.
I am going to Finish my 10 years in march 2019. If my fresh application is pending by that time can i very my application on 10 year basis? is my overstaying period count towards 10 years legal period?

Sorry ILR(LR)
If you apply for ILR based on long residence, your dependent must switch to FLR(M) and yes, there is a £18,600pa financial requirement that must be met and she has to meet the English requirement.

Her clock towards ILR based on 5 years residence will also be reset to zero and she will need 2 x 2.5 year visa for 5 years based ILR. Financial and English requirement must be met at each 2.5 year application stage.

I have one more question as my Extension application was refused and i applied for Fresh application now. As i am over stayer now and i can not work now.so i am no longer on my company payroll now. How can i fulfill minimum threshold income requirement now? any suggestion?

You mean ILR(LR) ?

Yes, you need the minimum income for your dependant to apply for FLR(M)

She will then likely have to apply on FLR(FP) 10 year PARTNER route - 4 x 2.5 year visas.

can you explain me How FLR(FP) works? what are the other requirements?

Google the form and see what is required. It takes long to get decisions on FLR(FP) and they are often refused.

If she has 10 years legal residence with no break in her continuous residence period then she can apply for ILR LR in 2019. She would need the FLR(FP) to be successful for the current overstay period to be ignored.

She also cannot work if she is now an overstayer or use the NHS.

There is nothing that stops you from getting dividends from the company as a shareholder. And, of course, having savings help also

Can you explain me what can i consider as income to make it £18500 threshold? do i need to prove only for last year income or more? How savings will consider?


Why this process is so complicated for dependent? it should be liberal for Dependent. if FLR(FP) refused often then whats the point having system? This is what we are paying for? after silly refusal reasons i do not have faith in UKVI. its so frustrating as i am loosing business because of visa issue. last 9 years hard work just vanished in few months.

thanks for directing me to right information. In Saving section i m little bit confuse as it says partner saving. does that mean my savings?
if my wife is having some savings from recent job.is it consider for income?

Hi Marcnath and seniors,

Can you please Help me out for below.

Yesterday I have received Latter from Home Office requesting FPS Detail information for all my employee. I have given them all FPS in my recent Application but they said its not sufficient please provide detail information. I have applied with same FPS detail in first extension application that time they consider the same FPS but this time they are asking detail information.

I have provided FPS with below details in my recent Application.
1. Employee Name
2. Surname
3. NI Number
4. Start Date
5. Leave Date
6. Irregular
7. PAYE Liability
8. NIC Liability
9. Late reason
10. BACS Hash

Can you all please suggest me what else i can add more here to fulfill requirements. If you can provide me example of Correct FPS detail so i can ask my accountant to generate. My Accountant is using Sage for payroll.

I have given 14 days to submit it.

The requirement is that the FPS should show all payments and deductions.

I don't see any payment info in the list - gross pay, net pay, etc

Others in this forum have used the XML file from sage. Search for Sage XML and you will see some examples

Can you please check below FPS report which my Accountant can generate from Sage. is that OK to Submit it? Below are the fields will be in my New FPS.

1. Employee Name

9. Employer NIC
10.Student Loan
11.Start Date
12.Leave Date
13. Gross Pay for Tax


Please suggest me or give suggestion if anything missing for New FPS.
