Tier 1 entrepreneurship visa refused - maintenance

I was refused on the bases of my maintenance fee. Money was added between April 4th to July 4th. Application made on July 10.

Have gone for 2 reviews and they acknowledged it was up to 90 days but still used the same rule to refuse it. I am faced with JR. please can u help advice if I fell short of the £945 as I had £1000 + all through the period

What was the exact wording of refusal letter (taking out personal info)?

They stated that the statements I submitted were from 7th March and application submitted on July 10. That the 31 days rule will mean counting from June 7. I added my complete funds from 4th April to 4th July. Thus they said it didn’t meet 31 days rule in appendix C.
They acknowledged the funds were up to 90 days prior to application

They said I failed to satisfy the 31 day rule under appendix C.

So what relevance is the date 7th March??

As I have asked, post the exact refusal letter wording for members to see and offer advice.

Upon review of your application u submitted your tier 1 1 application on 10 July and therefore the 31 day rule should start on 9 June . The bank statement you submitted started 7 March to 4th June and therefore falls outside the 31 day rule of paragraph 1a of appendix c.

These are their exact words. £1000 was in my acct from 4th April till November . So it’s really confusing to my solicitor.

So your bank statement was too old.

Did you not submit a bank statement drawn/printed a few days before submitting your application in July??

Forget about the funds being available for the period, it is the EVIDENCE you submitted that appears to be the issue.

The rules are very clear on how old the documents must be and if you submitted a document that is older than 31 days, HO won't accept it as the immigration rules are clear on this point.

Perhaps your "solicitor" is confused about the rules and requirements.

The state started on the 7th with end balance on the 4th of April as £1000. From then it was above a £1000 till July 4 and beyond and that was when I printed d statements

Why is it so difficult to state what the date you printed the statement ? "just a few days before" could mean anything.

If the date of the statement was after 9th June, the refusal was wrong.

I submitted statements for months starting April 4. And d the fund was there till July 4 and I printed the last statement on the 5th July.

They kept making reference to this all the 2 times I did administrative review. No new point!

You keep mentioning you "printed" the statement on 5th July. But what was the date of the statement. I can print the January statement in July - that does not help.

What exactly was the period the statement cover. HO's response seems to indicate that the statement was only until 4th of June, not 4th of July.

The confusion is that they started counting from March when the fund wasn’t there. My maintenance started from April 4th to July 4th. All statements showing

Here you state that the 1st statement ended with 4th April

Irrespective of what you say, if you have submitted bank statements until July 4th, then it is clearly a wrong decision. Just go for JR.

Thanks I will be notifying them tomorrow. Hopefully they will find the mistake n correct it before the JR. my worries now is that we loose our rights to work

Thanks for all the help. Home office still insist I did not send in the statement which I did. We have resolved to go for JR. Please I need some advice what the expectations will be. I still have the statements and don’t know what else to use to prove I submitted the documents
