Family visa extension - Tier 1 ET dependants

Post by drengshehata » Thu Jun 11, 2020 3:34 pm

Hi,
I am seeking for advice please. I am going to apply for family visa extension as dependants of Tier 1 exceptional talent visa holder. The main applicant is going to apply for ILR. Family, however has been in the UK for 1 year and 9 months. In your opinion, how long should I apply for visa extension, 3 years and then re-apply again for other extension to cover the remaining 3 months for ILR qualifying period or 4 years at once. Your input is highly appreciated.

A PBS Dependent extension is granted for 3 years when the main visa holder gets ILR or is applying for ILR. This is stipulated in the immigration rules and there is no discretion. They will only get 3 years.

Thanks a million for your input. What about the qualifying period for ILR. I am aware they should stay 5 years, however if I apply for 3 years now they will complete only 4 years and 9 months. Will this be an issue in future when applying for the ILR for them.
Thanks again.

They will likely need a further extension.

You could apply for this on this extension using standard service which will give them extra time as the extension is valid from date of approval not tagged into the last expiry date.

Note also that their qualifying period for ilr starts from the date their initial visa was issued and not the date of entry to the UK.

Dear CR001,
Once again thanks a lot for your efforts and support. Just a quick query please, while preparing the application documents to extend the visa of my family as Tier 1 ET dependants (now global talent dependent), the IHS surcharge was calculated £0 and I have only to pay the application fees. I feel something went wrong or do I have to pay for the NHS for the required visa period after I submit the application?
Thanks and regards

It's because you out your current visa expiry date. You should have poo it a visa expiry date of 3 years from date of application to get the correct IHS fee of £1200.

You cannot amend it once submitted. Ukvi will likely email you to pay IHS.

You could then start the application again with a different email address.
