my application details

Post by rajiv502 » Thu Apr 03, 2008 5:40 pm

Hi all,

I am sending my application details

Date Applied :19th march
Reached Home office : 20th march
Credit card charged: 25th March
Reference Number received :28th March ( PB3001....)
Decision : Awaited

I haven't sent any proof of my English qualification, with the assumption that it was validated by the self assessment tool.
Please let me know if that is fine. I am worried now as everyone seems to be taking IELTS, etc.

Thanks and best of luck,
Rajiv

Hi Ayleee,

Thanks a lot for all the information. One last query, if you can help me with ( if you can ask somebody). Is it ok if we show multiple accounts for the maintenance funds.

Thanks,
Abhishek

Hello mate, yes you can show multiple accounts. When i called the HO Call centre, they put a clause to it stating, "As long as these accounts are accessible easily for your day to day expenses".

BTW you mentioned you have provided a IELTS result of 7.5 supporting your English score. I also got a IELTS 7,but I didn't sent it ,instead I used my Master's degree that I got here in England in 2006 to claim my English score, you think that will still be OK ? Or do you think the IELTS is better proof ? I thought the Master's degree here in england is equivalent to the IELTS result over 6.5. What do you reckon?

the answers to your questions are below

I think you have mentioned you used to phoned HO a lot querying your application progress (every 3rd day), but what exactly did they tell you?
The answer i used to get was we cannot give any information on Tier-1 applications other than the fact that we have recieved it.

Since you mentioned your case has been approved on 19th of March,I am wondering what did they tell you when you querying about the progress after 19th of March?
well since 19th march i called them 4 times, i called them on the 1st of April which was my last call to them before recieving my docs , the guy who picked up the phone said we are looking into the cases as we recieve them, give us 28 days then we can update you on your case, upon my extreme request that my visa has expired on the 20th march and my employer is having a problem he said your application is under consideration and i cannot give any information other than this.
I've just phone HO, they actually didn't reject my query saying they can't provided any information. Instead, they used the system to search and the result is my case is still under consideration with caseworks.
well Lucky you, i wish they gave me some useful information as wel

Have you noticed any difference of their answers before and after 19th/March?
nothing that gave me a hint that it was approved.

Is that ture that your query result of their system remains 'under consideration' after your passport being sent to be stamped on 19th of March??
yeah i guess so , cause they alwaz said under consideration even on the 1st of April when they actually were stamping it.

well all i can think is that because i used to call after 4:30pm when ever i tried to ring them so maybe they just wanted to get ready to go home and not bother checking... i am just assuming ......

Hope this helps

Hi GobOOst,

U can fax it after getting the case workers fax number.
You can also send a change in circumstances form by specifying that you are submiting an extra form for English language requirement.
see the link below...

Re: my application details

Post by Gob00st » Thu Apr 03, 2008 8:38 pm

Hi Rajiv502:
Actually it is clearly stated in the policy manual regarding the English Language Requirement:

There are three ways in which an applicant can meet and evidence the English Language requirement, they can:

1>be a national of a majority English speaking country;
2> pass an English language test detailed in this guidance; or,
3>hold a degree that was taught in English and is equivalent
to a UK Bachelors degree or above.

So theoretically a degree taught in English specially a degree got here in the UK should be equivalent to an IELTS test result. The tricky bit is an IELTS test result is simpler than a degree since the test result doesn't need much verification while the degree need further checking to see if it was taught in English and equivalent to a UK Bachelor's degree or above. I reckon that's probably the reason why an IELTS result is more preferable for the caseworker (But if all caseworks are competence, responsible and do every checking necessary, a degree taught in English should be 100% ok).

Even though, I still didn't enclosed my IELTS result in my application package. Its partially bcos I sent out my application before I got the test results back and partially bcos theoretically it should be ok for me since I got my Master's degree here in England.

But I am faxing it tomorrow anyway for safe side consideration. Anyway I think even if you don't have a English test result, don't worry , it should be ok.

Wish all the best 4 all the Tier 1 applicants here!
Fingers crossed for all.

Hi Abhishek,

Yes U can submit multiple accounts statements ( but you should prove that you have the access for that ..what i mean to say that is those accounts to be in your name ...i think even if it is with your wife name also ok ).

But try to describe that in the cover letter...i.e maintenance funds cover letter.

Hi urgent:
Thanks for your advice, really appreciate it. I think change in circumstances could work as well.

So I will try to fax it to the caseworker directly first since it could save a bit of sending time. In case they don't allow it, I will try the change of circumstance way!

And BTW thanks for your summary table, appreciate your work.

Dear Rajiv502,

Even I also sent my my Engineering degree to prove my english language skills...I verified my university degree on the self assessment tool...and i also printed the self assessment tool output for my degree verification and attached with the application.

I believe that is sufficient to prove english language requirement skills...but IELTS test is always a safe bet...as there are incompetent case workers in the home office unfortunately :-)

Re: Are Mark Sheets to be submitted Mandatory ?

Post by urgent » Thu Apr 03, 2008 9:09 pm

Hi Tier1_Queries,

My answers for your queries are as follows...

Ans 1:As I know you don't need to submit your marksheets if u can submit your original degree award. Please verify that on the self assessment tool and print the output and attach with the application.

If you can get a letter from the NARIC certified that your degree is equalent UK degree, that will make the case more stronger. But i think it is not mandatory. Incase if you are submitting original degree and also a letter from the NARIC please prepare covering letter to reflect all these.( As some lazy incompetent case workers don't verify everything until unless you spoon feed them ..;-)...

Ans 2: Regarding Maintenance funds u need to be more careful, as it is one of the mandatory requirement. you are saying you withdrawn the money from your savings account and deposited in the current account...then submit all the bank statements( savings and current) with your application and explain everything in the maitenance covering letter...so that it will help the case worker to understand your case.....

As I know maintenance funds is very important if you apply EC from India and i don't think its a problem as it is in country application....but be cautious and prepare a good covering letter...

All the best,

Tier1_Queries wrote:Hello Tier1 Aspirants,

Its really nice to be here in the Immigration Board forum to share our ideas.

Ayleee.. Congrats on sucessful application of Tier1. I think you should be
one of the early birds to get Tier1 Visa. Others, wish you all the best.

I have 2 queries in my mind :

1) I could find reference to mark sheets being submited though original
degree has been sent along with the application. Are Marksheets
mandatory to be submited?

I hold a Bachelors degree and to be on the safer side i wish to submit
the letter of comparability by NARIC as well for claiming qualification points.

2) In order to show the maintenance of funds i recently took money
from an savings account (maintained in the UK) and put it in my
current account.

Now, my worry is, will there be any rejections by the visa officer stating
that there has been recently surplus influx of funds. ( I have read similar such visa rejections in another thread posted in this forum)

If this is the case, how about going forward in convincing the visa officer
about the proof of maintenance of funds.

Please Clarify.

Hi Urgent,

Thanks for the help dear. I woul be showing around 3 accounts that too joint with my mom.

I have enough FDs. So will that help. Also I got a letter from one of my bank in which there are more than 80000 INR ( 1000 GBP) but there is no activity on account since 2006 as I use it only for saving purposes. So if I submit the letter and the passbook will that be sufficient. (since it has no activity from 2006

Cheers,

UK tier 1 - Help needed

Post by Jedi001 » Thu Apr 03, 2008 10:35 pm

Hello Friends,

Congrats to Aylee and all the best to everyone who has applied for UK Tier 1.

Urgent; Aylee can any one of you please answer my questions, pleaseee.....
I have few questions regarding Tier 1 application as I planning to apply, could someone please help me out with these questions:

1. Maintenance fund: I am confused about Maintenance fund, Do I have to keep 800 Pounds in my bank account for the period of 3 months or Do I need 2800 pounds for the same period? Or 2800 pounds is amount which I have to show when I apply for visa clearance. Can I take a personal loan on my name show that as my Maintenance fund? is that possible or HO wont consider that...Please advise.

2. Dependants Visa: I am married and I want to apply for me & my wife together though I would like to visit UK first so that I can get settled over there and then my wife will join me. I have checked lot of immigration forums and there I have learnt that few people got their Entry Clearance rejected because the Case Worker thought that "the person doesn't wants to make UK as their home". Please suggest what should be best possible option for me.

And if I have to take my wife with me then what would be the amount which I have to show in my bank account to get the visa approved?

3. NARIC Certificate: I have passed my Bachelors degree from Bangalore university. I have checked the http://www.bia.homeoffice.gov.uk website wherein Bangalore University is listed in their database. Do I really need a NARIC certificate to prove my English proficiency?

For the moment I have these many questions only. I would really appreciate if you could please advise me on the above questions.

Kind Regards,

Re: UK Tier 1 - Applying From India

Post by urgent » Thu Apr 03, 2008 10:35 pm

Hi jedi001,

Please see the message which I copied from the BIA webiste:
====
This page explains what proof of maintenance you must provide to support your application to Tier 1 (General) - highly skilled worker under the points-based system to work, train or study in the United Kingdom.

Normally, when applying from within the United Kingdom, you will have to show that you have enough funds, by sending documentation showing you have had savings of at least £800 for at least three months before applying.

Because this is a new requirement and it may be difficult to prove this immediately, we have put transitional arrangements in place for applicants and their family members submitting their applications within the United Kingdom up to and including 29 June 2008.

Up to 29 June 2008, you do not have to show you have had the funds for at least three months before your application. You must only show you have the required funds at the time you apply. The types of documents you need to send to support your application are detailed below. Until 29 June 2008, they do not need to cover the three-month period, but they must be dated no more than a month before your application.

Initially when they introduced the Tier 1, it was mentioned on the website that you need to show 800 pounds for the past 3 months and after every transaction it shouldn't go down below 800 poubds...that means your closing balance on any day cannot be less than 800 in the past 3 months....but later on they modified(which is printed above ) and now they says that you need to show enough funds atleast while applying.

Ans 2: It looks like you are applying from outside UK ? Then you need to show enough funds as Entry clearence is tough as they expect those funds should feed you couple of months in UK even if you don't get a job and hence it is important.

Ans 3: probabily you don't need any letter from NARIC certified that your degree is equalent to UK degree. if your degree is recognized on the self assessment tool it is okay...but if u have time and want to make sure your case more strong then you may try for a certificate from the NARIC.

Please advise.

Re: UK Tier 1 - Applying From India

Hi Jedi001,

If you are applying from Indian then maintenance funds are very important. So,be careful while preparing the covering letter and also maintain surplus funds in your account so that its easy to get approval from India...along with the documents for maintenance funds please also provide the following along with the application

1).Accommodation proof in UK ( U can book a hotel for 15 days atleast ....or a letter from your friend saying that they can accommodate u once u visit UK).

2).If you have any job offer from UK then submit it also...
3).??whatever u think which can strengthen your stay in UK will help

If you are applying for your wife also with you then you need to show more funds...if it your case first then less funds would do.

Applying EC for your wife won't be an issue as it is a dependant visa.

If you are applying from Indian then please visit the following link to get more info...

Please see the message which I copied from the BIA webiste:

This page explains what proof of maintenance you must provide to support your application to Tier 1 (General) - highly skilled worker under the points-based system to work, train or study in the United Kingdom.

Normally, when applying from within the United Kingdom, you will have to show that you have enough funds, by sending documentation showing you have had savings of at least £800 for at least three months before applying.

Because this is a new requirement and it may be difficult to prove this immediately, we have put transitional arrangements in place for applicants and their family members submitting their applications within the United Kingdom up to and including 29 June 2008.

Pre-paid spl delivery cover with initial application

Post by urgent » Fri Apr 04, 2008 8:40 am

When you mail home office about the tier 1 applications, they are sending an email with FAQs ...and one of the question and answer is below

When and how will my documents be returned?

For sponsor - The documentation will be returned at the end of the case
working process through Royal Mail Post. If the sponsor wants to receive
their notification and documents by any other method, then they need to
send in the appropriate pre-paid special or recorded delivery envelopes
with the initial package they send to the commercial partner.

For migrant - Border and Immigration Agency will send back the
applicant's documents when a decision has been made on their
application. It will normally be sent by recorded delivery, but if the
applicant has paid for special delivery it will be sent back that way.
If the applicant requests and pays for a courier to collect their
documents, then we will dispatch to a courier.

It would not hurt if you submit the IELTS but 6 yrs old one will not be valid.

You should do the following:
1) Send you Kolkata degree to NARIC which would confirm that it is acceptable to UK Degrees. Otherwise, the Tier 1 people might say that there is no proof that your degree is up to the level of UK degrees.
2) If you have done your degree in English, take a letter from your University on their letter head that the medium of instruction was English. Some times on the degree it self it might say that the medium of instruction is english. But dont assume that they will accept this alone. Submit the degree and the letter.
3) In your cover letter you clearly mention that you had taken your TOEFL 6 yrs ago. Your degree certifies that it was in English and the respective letter is submitted.

Good luck
