Genuine Earnings Test - depth and nature of questioning

Anyone who has had an interview with UKBA on self-employment earnings, did UKBA officials approach the interview in a check-list manner (i.e. they simply take your answers to each of their questions and move on to the next one) or was it more probing (i.e. your story is being assessed holistically and each answer is probed with follow-on questions to probe for inconsistencies)?
Did you feel the people doing the questioning where trained for that sort of role?

I will be grateful for any advise you can offer.

hi there, it depends on case to case and objections raised by your case worker, it could be simple questions either and probing kinda questions with follow on questions too, but one thing to keep in mind, they are trained staff and they are there to find out the in consistencies, as they will start with brief intro and later examine that with th eevidences you submitted.

Hi Guys I hope Inshallah everyone will get his visa who has been interviewed can anyone tell me that interview is only who showed their income from self employment + employment or what about those who show their income only from employment can anyone help please.

Hi All,
I know it is a wrong forum to seek help but i thought it worth asking. I am going to apply for my 2nd Tier1 Extension. My case is quite straight forward. I have completed all the documents. My question is here that when they will deduct my fee my account balance will be negative. I have already submitted 92 days maintenance fund. Can it be affected on my Application?

My 2nd question is that I am going to skip my uk born child extension as we don't have any plan to go outside the country until next year (My ILR due). Is there any impact on my Application or ILR application if I don't include my child, although she has been granted visa as my dependent.

Your advice will be much appreciated.

They are not covinced with some answers which I gave in interview so on the basis of that they refused my application without any right of appeal...

Is your visa is still valid ...

If it's expire then you should have been given right of appeal.

kissmemissme sorry to hear that. if i were you, i would file for judicial review, arguing that they are using new rules on you retroactively.

interviews and even requirements that earnings should be genuine, were never a part of the program, they just adopted new rules and have no right to use them against people who filed months ago

it will never stand up in court, it's like the hsmp jr case basically.

of course HO will argue that requirements didn't change, just their procedures for verification have. but that is a bogus claim.

first, with new rules after 6th Sept, people would be submitting different documents or make different decisions about submitting certain things or not.

second, the rules used to be very simple, if they cannot say that your documentation was not genuine or not compliant with guidance at the time, they have no right to invent more stuff to throw at you.

Thnx very much Sagareva for ur kind reply .. Of course I won't give up.. I m gonna fight till the end of this matter.. They can't let me down like this.. I hv seen barrister and he advised me for Jr.. He said that there r some reasons for refusal is irrelevant with my application ..

Anyways let's see guys. I am positive and won't give up.. The only thing is that I hv to put extra effort, time and money to fight with their silly decision..

i personally dont think HO has a legal standing just to refuse case on interview basis ... they must have some documentary evidence to support it ...

people can and do get confused during such interviews ...

I personally think these interviews are a good idea. There are many who have misused the Tier 1 scheme by falsifying self-employment income. Perhaps if these people had not done so - and if the scheme had been properly policed from the start - than the Tier 1 scheme would not have been closed down.

A genuine highly skilled visa system is usually a very positive thing for a country. Unfortunately the abuse of a minority has ruined it all for all of us, allowing the UK tabloids to brand all Tier 1 users as cheats.

Those who are doing the right thing should have nothing to fear.

Yeah! i'm with you Dandm, it really spoiled the standard of the Category. And the interview is pretty good thing to keep its standard, but i feel they are too late now.

Yep, it's a shame it's come too late to save Tier 1. Really wish they'd been a bit more rigorous when they came up with this scheme. Ah well. Congrats on your extension.

Hi All,

I have applied for Tier 1 General extension.
My earnings are from my LTD. company which I own 100%.

I am drawing salary as employed director and dividend as 100% share holder.

As proof of income i have sent Pay slips, Dividend Vouchers, Accountant Income Summary and Letter, Personal Bank Statements (Confirming all monies online transfer).

Received an interview call at Sheffield and they mentioned in letter that I can send any documents I want to send before interview and not at interview.

Please suggest and guide if I need to send any other documents.

I had my interview on 7th November and still waiting to hear from them.
I am a Ltd company owner and also in employment.
The interview is for 35-45 minutes and they will ask you from day one you came to UK until now,so prepare for everything especially the dates of visa extensions and PSW.
Some members has already discussed interview questions in detail so go through them as most of the questions they are asking are same.

But i have observed so far is all those who have been interviewed have their earning contribution from self-employment? yet to know someone interviewed for all earnings claimed from being employed. Correct me if i am wrong.
Also if i go for same day, will this interview will be part of appointment, and i hope they take decision same day rather than defer it into postal mode?
