UKbound,

Did you request for consideration under old HSMP rules (in light of JR) or was it a straight forward application for extension under Tier 1 (no reference to JR and fulfilling the Tier 1 extension criteria).

It was a straightforward renewal. I didn't ask for any consideration under the old rules. When I applied initially it was already 2/3, and 5 years to ILR. :-(

By old rules I meant old HSMP rules for extension (when you did not require to meet the 75 point threshold for extensions) and not the 5 yr ILR rule.

Hi all,
Ref: HSMP extension-->switching for FLR now under Tier 1

It seems some people have had their case held up, even when they qualified under Tier 1 PBS criteria, wihout mention of high court ruling for HSMP.
Plus some people have got old HSMP --> to FLR under Tier 1' without tears'.
So it seems HO is not being consistent or there were some issues in applications which are on hold.
Does any one have more info on this ? I am due to apply for FLR( curently under HSMP) next week, so any insight will be appreciated.

I'm also going to apply for extension next week 1+3 yrs on HSMP. Would it be a good idea to reference JR in my covering letter so that if they 'decide' to honour court ruling, they can consider my application in that respect?

If you qualify under PBS Tier 1, why do you want to confuse the issue?
I believe some one has had their application put on hold just for that very reason.

Documents returned: 11-Jun

Had referred to JR but did not specifically ask for conisderation under old rules. Provided all necessary evidence to qualify under Tier 1.

It might not make any sense now to mention JR when you're applying for your extention even if you are able to claim the 75 points. But what you need to consider is that there will definitely be some advantage in future. Getting your extention under the "Old Rules" will mean you're still considered as old hsmp holder and any benefits of the "Old Rules" will be yours. Trust me, more and more changes are on the way and the moment you're made to switch away from the old hsmp then those new rules will apply to you. A very good example is what is happening now. It might seems a long wait now if you mention the JR in your cover letter, but I will say the benefit is worth te wait.

Obviously this is a personal opinion and that is exactly what I did when I applied for my extention almost 4-5 weeks ago and I'm happy to wait for as long as it may last. HO can't hold the application for ever and at some points with the mounting pressure, they will have no other choice than to send it back approved. It's just a matter of time!

Well I agree with Justice, the wait is worth it.....HO cannot hold passports of people for ever......more the time passes more will be the pressure on HO to take decision & react....I mean even HO would be knowing consequenses of delaying JR implementation to the boiling point before someone files another law suit against them.....which they in all probability will loose again!

Hi All,

I belong to the HSMP (1+3) group and just got my approval for FLR under tier 1 after completing 4 years on HSMP. My wife (dependant) and I applied from the UK. See time lines below:

Application sent: 10th May 2008
Ref. no. received: 12th May 2008
Payment taken: 12th of May 2008
Approval: Stamped on 20th June 2008 - 3 years till May 2011
Docs and passport received: 25th June 2008


Docs Sent:
12 months bank statements - used to verify income and maintenance funds.
Corresponding 12 months payslips
Contract of employment and employer's letters
Marriage Certificate
MBA Certificate - UK University
1st degree certificate - University on HO's self assessment database
Passports
No covering letter and no mention of JR

I beleive that wait is worth and will paid off in longer run..

Hi, My initial 2 years HSMP visa is expiring in end of Sept-08. Now as I have to apply for extension thru Tier 1 (General), I need some clarification from hsmp experts on the below queries:

1. There was no english language requirement when I applied for HSMP in Aug-2006. Currently in the self assesment tool my Engineering degree qualification is listed. Still do I need to write IELTS or not?

2. Also while filling up the self assesment tool I am a bit confused on whether to say yes or no to this question:

Question: Are you already in the United Kingdom under the Highly Skilled Migrant Programme (with permission to stay that relates to an application for an HSMP approval letter issued under the immigration rules in place from 5 December 2006)?

Eventhough I am in HSMP my initial approval is before 05th Dec 2006.

Can anyone help please?

Hi Ram,

If your Degree qualificaiton is already listed in the self assessment tool then you dont need to take any other exam to qualify for english test. But better you try to get the 'Medium of Instruction' certificate issued by the University.(This is again optional).

Re: second issue, if you have got apprioval before 5th dec 2006, say YES and see what the final result of the tool. I think the self assesment tool you can use any many number of times as you wish.. and every time you make some changes and see how is results. BUT is will say, give the facts so that the case is not misleaded..

Hi All,

I am on HSMP (1+3) and just got my approval for FLR under tier 1 after completing 4 years on HSMP. I applied for my wife 2 kids and myself one month before expiry of the existing permit.

Application sent: 12 May 2008
Ref. no. received: 14 May 2008
Payment taken: 13 May 2008

Then I got a call form the caseworker on 17 June to say that I need to send a separate application form for each of my dependents, which I posted on 18 June 2008
(in my first application for FLR 3 years ago we only needed one application form for all of us)

Approval: Stamped on 8 July 2008 - 3 years till June 2011
Docs and passport received: 10 July 2008


Docs Sent:
12 months payslips
P60 to cover same period
Marriage Certificate
2 Birth Certificates
Degree Certificate
Passports
No mention of JR

I have posted my flr(o) application to get my daughters visa stamped.
My visa status is HSMP valid till Aug 2009.

Time lines:

Application sent:8-July
Application received:9-July
Reference recived:10-July
Payment deducted:10-July.

Can anyone pls give me howmuch it takes to get the documents back.I'm traveling to inda 23rd Aug.

I am going on a holiday to India for 3-4 months and I got HSMP extension approval letter couple of days back. Can I post my passports from India to UK home office to get it stamped or do I need to get passport stamped in india itself.

Hi Sreedhar, I applied (my HSMP to Tier 1 extension application) on 08th July, and below are my timelines:

Payment Deducted - 09th July
HO Letter confirming the reference number (recd by post) - 11th July
Approval - Awaiting

Think it will take a solid 6 weeks as per the other friends posts in this forum.

Hi, In my case I have spent already 2 years in work permit and 2 years in HSMP, that's the reson I applied a bit early. Otherwise you need to apply only 4 to 5 weeks before. If you apply early then they will stamp from the application approval date, then you will fall 1 or 2 months short of 5 years for applying ILR. Hope this helps.

Hi all :)

I am really happy to get my extension on 17th July 2008 for three years.
I applied on 30th May
Amount Deducted on 2nd June,
Visa dated 15th June
There is no 'Visa Valid from Date' but
Visa valid until start date of visa (13th June) 2011.

I got the courier and soon after that couple of hours HSMP JR Policy document and Application form uploaded onto the site.

I am not sure what will be position after 3 years but I am very very happy as of now...
