Query reg. Tier1(General) dependent ILR

Hi

As per recent changes (more than 180 days away from UK), experts could you please suggest when they are eligible for ILR ?

Entry clearance date : 08/04/2014

Entered UK on : 24/04/2014

Left UK on : 16/06/2014

Again entered UK on : 05/04/2015, they are in UK

Visa valid until : Aug. 2019

Could you please suggest, are they eligible for ILR during April 2019

Only absences from the UK during periods of leave granted under the rules in place from 11 January 2018 will count towards the 180 days. The absence in 2014/15 will be disregarded.
(Casa, not CR001)

It means, this 180 days out of UK rule is not applied if they are out of UK for more than 180 days earlier to 11/01/2018...Thanks,

Here, my question is absence during 6/2014-4/2015 is around 10 months, do they consider this period for ILR ? after 5 years completion(4/2014-4/2019) or they need to wait to fill this gap ?

Note : Their visa is continue from 4/2014

Guidelines are giving confusion, they are combining earlier, new rules.

Absence prior to 11th January 2018 are NOT relevant or counted!

Thanks, for your quick response....

It means, their 10 months away period during 6/2014-4/2015 is not an issue. They can apply ILR after completion of 5 years(i.e. in 4/2019) from the date of entry clearance, since they entered UK below 30 days after entry clearance.

Now, main applicant is on British Citizen through Tier 1 Gen. 5 years route. Could you please advise on my below queries :

01. When we apply for ILR for Tier 1 General dependent(5 yrs. route) through premium/same day service, can main applicant can accompany / go along with their dependent during the visa process in to the PEO

02. Do we need to show earnings, bank balance / funds etc., for dependents ILR

03. Do we need to mention out of country duration before 11/01/2018, when they are away for 10 months during 6/2014-4/2015( it is more than 180 days). No visa break...

04. Recently anyone applied ILR for their dependents with more more than 6 months away from UK before 11/01/2018

Thanks, for your answers....

With reference to your answer "PBS dependant visas granted before 11/01/2018 have no absences requirement" for my 3rd query. If dependents are out of country for more than 180 days(In my case, they are out of UK for 10 months) before 11/01/2018(their visa was renewed before 11/01/2018 & not required further extensions), then no need to mention, explain anything about past absents ? Regards,

As I said there is NO absence restrictions on PBS dependants when the visa was granted before 11/01/2018
