ILR through Tier-1(General) dependent after April 2018

hi All,

I am also going through the same boat. I have a little doubt that Tier 1 Dependants will be able to Apply for ILR after 6th Apr 2018 because I couldn't find anywhere where UK Visa and Immigrations has mentioned about Tier 1 general dependants. The UK Visa and Immigration website only says "From 6 April 2018 the Tier 1 (General) category will be closed to applicants who want to settle using this visa route."

Has anyone tried confirming the query with the Visa Enquiries via email or call "03001232241"? or has some reference material i.e. document, article, addendum ref etc. So that we can dispute it if we can't apply for ILR for Family after 6th Apr 2018.

The HO link says Tier 1 General 'worker' and not 'dependent'. The April 2018 is ONLY for the Tier 1 General Main visa holders who cannot extend their visa anymore or apply for ILR after April 2018. It DOES NOT apply to Tier 1 General dependents.

You can apply to settle as a Tier 1 (General) worker until 6 April 2018.

Thanks for response. I tried by applying as a Dependant for ILR and I think you are right CR001.

When I tried to apply for ILR as a Tier 1 Dependant, I get the following text:
"
Eligibility for partners

Your current visa must be as a dependant on your partner’s tier 1, 2 or 5 visa.

If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead.

If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead."

Hence the Route through Tier-1 (Gen) Dependant will be closed but as a dependant you can apply for ILR as a partner of a settled person and you will qualify for 5 years continuous stay under Tier 1 dependant visa.

Does that make sense? Please correct me if I understood it otherwise.

Sorry, I don't know where you are getting that from. I don't have access to the online form.
Your current visa must be as a dependant on your partner’s tier 1, 2 or 5 visa.

Can my Child apply for ILR while other Parent is on Tier 1 Dependant

Hi,

I will be eligible to apply for ILR in Jan 2018 but My partner and child joined me in UK 6 minutes later hence they haven't completed 5 Years continuous stay in UK.
So far I am thinking of Applying for ILR for myself (cost 3k) and Extension for Partner and Child (cost 4.5k). I will have to apply for ILR six months later again (cost 6k). which is quite a lot of money by any standard.
I am wondering if I can apply for ILR for my child with my ILR because Child's ILR doesn't require the condition of continuous 5 years stay.

Can someone advise? to save some money from this extortion?

Was the child born in the UK or abroad?

Children born abroad follow the immigration path of the less-privileged parent and are eligible to apply for ILR with the less-privileged parent. The number of years requirement does not apply to minors.

The child will follow the same route as the other parent and qualify for ILR after you.

Another clarification. For the Same day Premium service for dependent service. Do I have to pay for both my Spouse and Child i.e. £590 x 2?

I think Its obvious that £590x2 will be charged but just want to confirm.

Yes. Each applicant has to pay the premium service charge plus the visa fee.

Hi,

I am filling the applications forms for myself and family and need some help on dependant's application.

Main Applicant - Applying for ILR (My Tier 1 is expiring on 19th Jan 2018)
Dependants - Applying for Tier 1 (General) Etnx

Dependant's application is asking and I don't know what to provide:
1a) Which visa or permission to stay has 'Main Applicant' applied for or been granted? and 1b) Do you have one of these Home Office reference numbers for 'Main Applicant'?
Shall I provide the answers for 1a) Tier 1 General and 1b) "No, I don't have a Home Office reference number for them" because ILR application is also getting applied at same time or "give Biometric Resident card for Tier 1 of Main Applicant".

2) While paying Immigration Health Surcharge payment it asks for end date of the Main Applicant's visa. Its a Mandatory field and I have to provide a valid date so that IHS can be calculated and paid.
My dependants need minimum 6 months extension to complete 5 years of continuous stay period. Can I provide a date 6 month or 12 months in future? It also asks me to Declare and Sign all the information I am providing is accurate. Which makes me a bit nervous that If a wrong date can be classified as Fraud.

Please advise! Thanks in advance for all the help.

Tier 1 Dependent extension and main Tier 1 ILR

Hi,

Due to my visa timelines and rules. I have to apply for Tier 1 General Extension visa for Dependants and ILR application for myself (Main Applicant). Visas were expiring on 19th Jan 2018 and Main Applicant's 5 years continuous stay (28 days early) was completing on 14th Jan hence ILR can't be applied earlier.

Tier 1 General Application was submitted Online on 11th Jan 2018
Sent the printed application and requested documents on 16th Jan 2018
Completed BRP enrolment for Dependants on 20th Jan 2018

However for ILR application it went to a different address in Durham and I haven't received acknowledegement yet.

ILR application sent via post on 15th Jan 2018
Application was delivered on 16th Jan 2018
Processing Fee deducted from the Credit card on 17th Jan 2018

In dependant's application I couldn't provide any details like ILR application number because I haven't received any letter or email from Home Office.

How the Tier 1 General Dependant's application will be progressed without any decision or details of ILR application?
Will the application stay on hold until a decision on ILR application of Main applicant?
I am worried, Home Office shouldn't reject dependant's application.

Please advise, If anyone has had similar scenario.
