Tier 1 Dependent Rejected Marriage Certificate Translation

Hi All,

I am in UK on Tier 1 for over 2yrs, being alone here and feeling lonely, i deiced to get married and i did get married in May 2010 back home in India. My wife applied for dependent visa which got rejected. However she is given a chance to appeal against the decision within 28 days.

Reason for rejection :- Embassy is not convinced that Marriage Certificate Translation is done by a professional translator, it did not have any credentials of the translator and does not state the translation is accurate.

However the translation was done an registered Advocate on Government of India Stamp Paper which is accepted in the Indian Court of Law. Keeping this in mind we did not double check if this was acceptable to UK Embassy. My mistake.

Anyways we are going to appeal but this time i want to get this perfect. My question is this
1) Does anyone know of someone in New Delhi, Noida or Greater Noida who can do this translation acceptable to UK embassy?
2) Is there a format or template for translation that i can use?

Point to be noted :- I am a Muslim, so my marriage certificate (Nikahnama) is in Urdu language with bit of Arabic on it and this document is acceptable Marriage Certificate in India. So I cant get marriage certificate from local government office.

Please help me to get this right. thanks in advance.

If you can submitt addtional document in review then thats fine.. you have a good chance of winning the visa in review. However if immigration rules do not allow applicant to send addtional document in review then my friend there is no point in sending a review. As you were required to submitt translation of marraige certficate by proper translation company on their letterhead.

If rules do not allow you to submitt addtional documents in review, thne I would advise you re apply the visa with new visa fee and with fresh set ot documents.

This link on ukvisas site clearly indicates that additional documents are accepted in ECM review.

Regarding the marriage certificate, now a days you can get nikahnama formats in both urdu & english. u can get one of those and ask ur witnesses & advocates to sign again & get it stamped from the Kazi who solemnised your marriage. ( I can say that , because I got married on 5th june & I used it (without any translation) and had no objection on it. )

However translation should also be straightforward from the patiala house court. Any advocate there will be able to get it done.

I am very sure that addtional evidence can not be submitted along with the reviews of PBS based refusals.

Additional evidence can only be submitted in AIT appeals.

Others please comment on this.

Decisions on EC applications as dependent(s) of Tier 1 (General) migrants can only be appealed. These decisions are not subject to administrative review.
Do dependants have a right of appeal? wrote: Dependants of points-based system Migrants have a limited right of appeal where the main applicant has had their entry clearance application refused. Where the main migrant has been successful in their entry clearance application, their dependants will have a full right of appeal, if their application is refused.

Administrative review is the process used to look at whether claimed points have been correctly assessed and therefore only applies to the main migrant. Applications for entry clearance made by dependants are not assessed on ‘points’.
