Travel within 28 days after grant of visa

Travel within 28 days after grant of visa

I was granted visa on 25 April. Do I need to travel to the UK before 21 April to claim grace of 28 days?Is there any rule as per which if one goes to the UK with in 28 days of visa approval then thsese 28 days will not be counted in 90 days which one can not spend out of UK if he wants to claim indefinite leave to remain?

The rule is one cannot be out of the country for a continuous period of more than 90 days and a total of 180 days in 5 yrs.

The count starts from the day you enter UK and not from the date of your visa.

It is suggested to enter within 28 days so that you would not have to go for an extension twice.

Thank you aruni, but I am still not clear about how entering within 28 day from the date when visa got stamped will help not applying for 2nd extension. Apologies for my ignorance.

Sorry it was supposed to be 'It is suggested to enter within 28 days so that you would not have to go for an extension twice before applying for ILR.'

You are allowed to apply for ILR only from 28 days before your 5 year qualifying period is met. So, if you dont enter UK within 28 days then you need to extend your visa again to fill that gap.

Does the same apply for dependents of Tier 1 ? i.e. no 28 days limit?

I have been told that the approval letter for Tier 1 dependent visa has this condition ? !

Suppose my visa got stamped on 25 March 2010 and I entered UK on 26 April 2010.I apply for 1st extension on 24 march 2013 and I get extension on 14 April 2013 (visa getting stamped on 14 April though I applied on 24 March 2013) for another 2 years that is till 14 April 2015. So AS PER 28 DAY rule I can apply from 29 March 2015 to 26 April 2015 as i entered UK on 26 April 2010 and will be completing 5 yrars on 26 April 2015 but as my visa is expiring on 14 April i can apply from 28 March 2015 to 14 April 2015 without needing 2nd extension though I entered UK on 26 April 2010 beyond 28 days of grant of my visa on 25 March 2010.

Please point ot where my understanding is getting wrong.

Where can i read about this 28 day rule?

Normally when you apply for extension, you will get your visa extended from the date your first visa expires and if the date of decision is later than the visa expiry then from that date.

The How to apply for settlement section lists the categories of migrant who can apply, and explains which application form to use. You must be in the UK when you apply using one of these application forms. The only migrants who can apply for settled status from outside the UK are certain partners and family members of British citizens and settled persons.
Please do not send us your application more than 28 days before you become eligible to apply. If you do, we may refuse your application with no refund of the application fee. However, you must make your application before your current permission to stay in the UK expires.

One can apply one day before visa expires so if I apply on 24 March 2013 then obviously decision will come later than 26 march 2013 giving some grace period even if I dont enter UK with in 28 days of approval of visa.
Is my understanding correct?
