How to Appeal

Hi
My EC got rejected.The reasons for it in brief are
1>Employment letters doesn't reflect as if they were issued 3 and 1/2 years back.
2>Payslips are printed in bulk rather than taking them month by month
3>e-mail bank statements are submitted where in we actually accept true copies signed by bank authorities.
4>U stated a cousin of u provides accommodation for u in U.K.but there is no proof to show ur relationship.

Now i want to appeal against their decision(they have provided a appeal form with the rejection letter). What is the procedure to do this? is it compulsory to hire a legal adviser ?(I have done the whole HSMP process on my own).What docs should i additionally attach to support my cause?
what should be my strategy in challenging the above points?

Can any body tell me that while applying for entry clearance whether our Points are again calculated on basis of documents provided or Entry cleanliness office have no concern about the points of HSMP.

The other things which confused me that whether I should submit all the documents with EC application form which I was submitted while applying for HSMP. Whether EC Office TALLY OUR DOCUMENETS.

Hi,
U will have to submit the complete package sent to the Home Office to the BDHC also along with updated pay slips and bank statements. They will again verify everything.
Immigration law is mystery and a mastery in obfuscation, and the lawyers who can figure that out are worth their weight in gold.

my ec got rejected on 21st february and i appealed on march 18th.can anyone give me info whether we can trace the appeal request/time line it will take to annouce the result.Will thay again do the entire verification process?

Upon my experience the appeal process takes min 6 months to a year to know the result-

It is nice to have a forum like this, which gives lot of information about HSMP visa and other aspects of it. My sincere thanks to everyone who has posted here. I am also planning to apply for HSMP or I should say UK Tier 1 - GHSM within this year (mostly end of the year). I have a doubt which I would like to clear first hand.

" Your account show large recent deposits, which are not consistent with your account history,you have not satisfactorly explained the reason. Also you have shown affidavit from your father states that he has gifted 3,00,00 to support you in UK, but you are failed to submit sale dee and an enumbrance certificate for this.

-- get a letter from your father and tell the BHC officer that your father has gifted the money to you. Also add a sales certificate.
-- The above documents shouldbe in ENGLISH.
-- Get a seal and signature from a Notarised official.
-- Attach the letter with your new application. "



I found the above post in this thread. I have a question regarding one of the above answers.

My Questions are:

"get a letter from your father and tell the BHC officer that your father has gifted the money to you. Also add a sales certificate"

Q's:- What Sales certificate we are talking about, are you saying that your father sold some land and gifted you the money, lets say my father just gifts me the money from his bulk income which he got from his retirement, Do I have to file his retirement documents?

Hope to get answer for the above question soon.

Non-resident applications for EC

I think most of the people on this forum have gone through the Indian application process which seems to have slightly different rules, but anyway...hopefully someone can help.

I'm Australian, living in UK under the working holidaymaker program. I got my HSMP approval letter on 3 March 08 and now have to apply for the entry clearance. Is there any country that anyone knows of in Europe where they'll accept EC applications from people who are only there as a tourist (such as France, Germany, Spain, Bulgaria etc).

I know the UKVisas site says there may be delays if you do that and that they dont HAVE to accept applications, but has anyone had any luck with these situations? In terms of fees anything under 1000 Euros is still a good deal.

Congrats on ur EC approval. I salute your courage. Lesson to learn by everybody-You don't loose anything by trying. The EC officers are not God and should not be worshiped nor feared.

My HSMP has been approved now iam going to apply for EC but i have one question. The time i applied for HSMP i showed that iam doing two jobs one full time and one part time, now iam a bit confused that may i still showed two jobs for Ec or only one full time. If i show that iam doing 2 jobs then BHC verified from 2 employers, so what you guys recommend may i show only one full time job or both. One of my colleague have the same case but at the time of EC they showed only one full time job, he said if the BHC inquiry me about the 2 job then i give reason that i resiagned from my second job, i only doing that job to get the salary points, so i got the approval letter thats why i resiagned from part time job and they got the approval with that one.

REASONS GIVEN BY THE OFFICER FOR REJECTIONS ARE
1) NO JOB OFFER
2) NO REGULAR INCOME
3) PARENTS BANK SAVINGS SHOWS AMOUNT 64 THOUSAND
4) MY BANK SAVING SHOWS 61 THOUSAND
5) DONT KNOW ANY BODY IN UK
6) PROVISIONALL BOOKED HOTEL ACCOMODATION
AND WILL DEPLETE ALL THE PARENTS SAVINGS AND THE AMOUNT WILL LAST FOR SHORT TIME IN UK.

MY EXPLANATIONS
1) HSMP CATAGORY DO NOT REQUIRE JOB OFFER IT IS IN THE CATAGORY OF WORK PERMITS
2) FOR TYHE LAST THREE YEARS I AM EMPLOYED AND WITH NO BREAKUP IN BETWEEN AND RECIEVING CONTINOUS SALARY FROM THE COMPANY TILL DATE

4) MY SAVINGS SHOWS 61 THOUSAND BUT WHICH IS TAKEN IN THE MIDDLE OF THE MONTH IE 14 JAN 08 BUT IN THE MONTH END IT WAS 100000 ONE LAKH APART FROM THAT I HAVE PROVIDED FD'S OF 60000
SIXTY THOUSAND ALSO WITH MY WIFS JOINT ACCOUNT. BANK STATEMENTS OF THE LATEST WAS ALSO PROVIDED ALL WITH SEALED AND SIGNED

Thats rubbish
I tell you...this all might have started coz of your less savings shown.
I am afraid, because I am in same boat as urs..as i dint show any job offer....no hotel accomodation....but good savings...lets see.

Will be there in day or two.
I have my ILR since march 2013, previously based on HSMP+Tier1 ext. All views are my own, am not a professional on immigration matters.

Hi All,

I applied for EC on 26th Feb 2008 and got rejected on 10th April, 2008.

The reason for the failure is:

1. Misspelt subject name in one of the marks memo. Subject with word "System" was splet as "Sysem". So based on that the officer didnt give me any points for my education qualifications though I have given my original M.Tech Certificate Degree.

Now I am planning to go on dependent visa and try to search for a job in UK.

Will dependants get considerable preferance for the job.

I know I can appeal or reapply. But can not do because of some coinstraints.

Please give me some inputs.

Dependent VISA is as good as the main VISA so you would not face any problems on that account.

FD's are not considered as liquid assets.Take a personal loan and reapply.

Prepare an estimated expense sheet (per month) including items like stay, travel, food etc. Include this sheet with your application. I understand that it is reasonable to show funds sufficient for sustaining a person for three months without job. Anything 5k+ should be on the safer side (will actually be a bit on the higher end but as they say, the more the merrier)

EC Rejected on Salary Issue from Pakistan!

Dears all!

Please help me and i need ur quick resopnse!


My Ec got rejected during verification process. I clamied point on Salary in Cash. But in Telephonic Verification, Manager said that company gives salary in Cheques and on demand payslips are issued, further more Manager said that employee is not restricted to submit those in some specific bank, it totaly depends on employee choice where ever he wants he can submitt cheques in any bank. But i often get salary in Cash from the finance department.

BHC stated that if u get salary in Cheque then why ur bank is not showing those cheques details in the statement.

So thats y they rejected EC. I have to go for appeal so what do i do? How much time appeal will take?

I request to all of you.Please please help me!!!!!!!

Hi Guys,

This is my first post to this forum, i have got my HSMP approval but my EC was refused. The reason the gave me for my resfusal are

1)they consider the letter from my current company as not genuine.
( although it is reputed company based in UK, and i am working as an independent conttarctor for that cmpany in Pakistan, also i have job offer from the same company to join them in their UK Office).

2) They could not verify the contact no of my company and address from me,
( i was in meeting when the visa officer calls me and i could not answer him the exact contact no/address of my office and reporting manager which is also based in UK, as i am an independent contractor and reporting directly to UK).

I have all the necessary documentation to prove my case, but they did not contacted the company.

Really i would like to request some guru 's here to help me out what should be my next step, either i should go for appeal or review.

Also can i go for fresh application again? as i have my HSMP Letter with me.
What is the shortest and safest path here as i have a job offer and my company wants me there.

Hi,

I had obtained HSMP approval but my EC got rejected.

Reason provided to me by ECO is

I do not hold GBP 2800 for three months.

I have deposited some GBP 4600 in my bank account and taken bank statement after two days. I was not aware that I require to show a minimum balance of GBP 2800 for minimum three months.

Does anybody know this rule is mentioned anywhere in any UK Home Office document or website. If you know this, please let me know.

I have sent an email for an Administrative Review. It had already been eight days, but there is no response.

In addition to this, my original HSMP Approval letter and original bank statements are not returned. I had applied through VFS New Delhi.

I had inquired about the missing documents, I had sent an email to visqry.newdelhi@fco.gov.uk, vfsuk.north@vfs-uk-in.com, postmaster.nedel@fco.gov.uk, ten days ago, but there is no reply. These people are very clumsy and slow.

Can any one, please guide me about my next steps. I feel cheated.

The minimum balance of £2800 for 3 months is valid under Tier 1 and not HSMP.

So if you applied on and after 1 April I assume it would be Tier 1 that is if the application was made in India.

If the application was made outside India and in a non-EEA country then it would have been an HSMP application and the £2800 rule wouldnt hold.

Did you use a Tier 1 form or an HSMP form when applying for EC? Maybe they should have returned the application to you without processing if you used the HSMP form.

Dear khanahah,

If you are in urgency, then re-apply. However, the BHC stamps in green at the last page of the passport. Also the biometrics tell that you applied earlier and got rejected. So ... you'll have to write in the VAF2 form, the reason in the columns asking that have you applied before for the visa.

The appeal process takes 6 - 8 months till which your HSMP letter also expires, so there is no chance of re-applying for Visa after an unsuccessful appeal. i.e. You'll then have to apply for HSMP again (IF you fail in appeal process).

But consultants do say that there is good chance of success in appeal if you have solid proof and your case is genuine.

However, either you re-apply OR you go for appeal, submit strong proof with the application including; another letter from your head on company letterhead stating something like if the Visa people have any queries about you, they should contact on the numbers on the company letterhead.

Also, search your company's info on Federal board of revenue's website for NTN information and on Security and Exchange commission of Pakistan for company name.

Send them the exact links of both of the websites showing your company info.

Dear JAH,

Either re-apply or go for appeal. (Read my reply to khanahah) Your choice.

Tell them that you receive cheques, however your company gives option (a written form or something) which gives option either to receive cheque or get salary in cash OR that you have personally given an application to the accounts deptt to receive salary in cash. And tell that the person with whom the Entry clearance officer inquired does not know the exact details of each employee whether they receive cash or not. However generally, all employees receive salary by cheque.

OR you can say that you receive salary by cheque and deposit it in another bank. Then you transfer money with the passage of time in the bank whose statement you showed.
