Urgent: EC Rejected

EC rejected with the following reason. It is a silly mistake in filling the application as i mentioned regarding one of my previous rejection under part 6.3 but not in part6.8 of my VAF9 application. They are expecting that info in part 6.8 as well. But as I already gave rejection details in 6.3 and I thought the 6.8 is something different.sent for admin review and not sure what is going to happen.

Your earnings at the time of EC application also should be inline with the earnings, you have mentioned while applying for HSMP. VFS will do a verification of documents (Integra screening), which you have provided. They may contact your employer in this regard.

Now, not only have I not had a source of income for the past eight months (so my income for the six months prior to applying for entry clearance will not match the income indicated on the HSMP application), I don't have an employer either.

My questions:

• Is it advisable for me to apply for entry clearance now? I note from the initial few posts in this thread that the British High Commission or Consulate may try to see if the HSMP criteria still apply, in which case I will not qualify, since the bulk of the points I earned were based on income.
• If not, is it advisable for me to find work in India now, in order to bolster my income, and then apply once I have earned a substantial amount?
• If it is advisable for me to work here, how long should I work? I have about five months left to apply for entry clearance (nearly a month has passed since the HSMP approval letter was issued) which is clearly a smaller interval than the six months for which I would have to indicate income to apply for entry clearance (and it will take some time for me to find a job especially after a long absence from employment, as well as some time for the application forms for entry clearance to be processed towards the end of the period).
• If it is not advisable for me to look for work, what else might I have to do to be able to gain entry clearance successfully?

I've searched the Web to see if anyone else has been in this situation; I only found one post on another board about it, and that individual never received an answer.

These issues have had me worried sick over the past few days as I realize I should've checked and rectified these things at a much earlier stage, and that it may be too late to do anything about it at this juncture. However, now the damage is done and I need to make the most of my situation. Has anyone had experience applying for entry clearance in a situation even remotely similar to mine? If so, please help me in resolving the situation by providing advice.

I'm glad to follow up to this post made on August 8 to report that I finally applied for transitional Tier 1 (General) status in the first week of January this year and received my passport with a visa stamp in the first week of February. So it turns out one need not be employed since the issue of an HSMP approval letter in order for a successful transitional Tier 1 (General) application. (This is of limited use for Indian applicants, but applicants from other countries who have received HSMP approval letters that are still valid, have been in my situation and have yet to apply may not need to worry.)

As far as maintenance funds are concerned, I had roughly three times the amount as fixed deposits in my bank. I had the bank issue a letter (on letterhead) that listed the fixed deposit accounts, their dates of issue and maturity, the amounts, as well as a paragraph from the bank's policy document indicating that the funds would be made available immediately upon request (this is crucial I think). With this letter from the bank it was clear that I had had liquid funds in my bank for over three months. I did not submit any bank statements aside from the ones I had sent to Sheffield for the initial HSMP application, since the letter sufficed as proof of maintenance funds.

In summary:

HSMP application received at Work Permits (UK), Sheffield: Last week of March 2009
HSMP approval letter dated: Second week of July 2009
Tier 1 (General) application submitted at VFS Global (visa processor): First week of January 2009
Passport received with Tier 1 (General) visa: first week February 2009

I sent 2 bank statements of different accounts. 1 for saving and 1 for salary. I wrote every thing clearly in two seperate cover letters but still he considered my salary acccount statement for maintainance funds and rejected my app.

HE said that on bla bla date, i dont have enough funds. He is right but he has considered the wrong account.

I am going for AR. But i dont know how to do it. Is there any fee for it?
What is the required before applying for AR?

ur case is simple, u'll be successful in ur AR. Apply as early as possible to get resolved.
My visa rejected on 18th the reason being "ur bank has verified the statement is not genuine"...i've applied for AR on 26th March.

Other then this form attach those documents, particularly related to ur refusal i.e. in your case all maint. fund documents (note that one photocopy of all ur documents is already with the concerned ppl)

Note the clause of your refusal and check in refusal note weather or not you can attach additional documents in AR?

There is no fee for AR
Gerry is not required now, you have to sent documents directly from where ur application refused (Abu dhabi or BHC isd)

Even after getting required info, i've applied via consultant..

thanks loodk. My application result has written abu dhabi on it. So i think it shud send it back to abu dhabi.

My application has not been refused under clause where i could attach the supporting evidence. So, i think just that form would be enough.

I will be submitting it tomorrow inshALLAH

WoW ....I applied for Admin Review on 21/10/08 and I heard back on 26/03/09 nearly 5 months .The decision is in my favor .I had not provided supporting letter from bank and had simply provided bank statements attested/stamped by the bank ,that ws the reason for rejection .

Unfortunately they have approved my application[Bank A statements] and rejected my dependents on the basis that some [Bank B Statmnt] pages did not have my name/account no details .

Summary:
1.Always get statements from bank[no web/inet banking printouts] and ensure each pages has your name/account no and is attested with a bank seal And a separate cover/suporting letter from Bank.

2.Never risk applying for your dependents with the main application even if you think you meet all requirements .Maintain funds and apply as soon as main applicant is approved.

I was unable to get this letter and did see some posts where applicants were able to get through without this letter and plain bank statements .

BHO/ECO need to be a little practical and considerate to applicants and consider these Banking complications in different countries that are not in hands of the applicant.

no,i havent got any response yet. The form reached there in abu dhabi at 7th of April (as their website shows) but no response as of yet.

Hi, no but you can give them a call every few days to find out more. On the homeoffice website it says admin review takes 28 days and its already 20 days since they received your request.

Additionally, you can also ask them how long it generally takes them to give back a review decision.

Hi everyone,

Can someone help me out with this because this is causing quite a lot of heartache. I went through an agency in Dec. to help me secure my Tier One HSMP Visa (General). It has been a nightmare since I originally sent off my application in late Feb. 2009. There has been a few problems along the way where my application has been returned.

My application recently got returned to me just over a week ago because the caseworker saw the date of 08/08 on Page 8 of the Tier One November 2008 version and thought that we had used the wrong application form. They immediately sent back my application along with my fee of £750. When they wrote a letter to my agent telling them why my application was considered invalid, my agent wrote back to explain that Home Office had made a clerical error, stating that our application form was indeed the correct one and that a mistake occured on the Nov. version of the Tier One HSMP visa application where the date of the previous 08/08 version appeared on page 8 of the Tier One 11/08 version. My agent even cited examples where a Tier One Visa was secured for several of her clients using the same form. We have now re-sent my application for the 3rd time with the enclosed fee and have been given a new reference number.

I am so distressed because of the time that it is taking with so many mistakes being made along the way. My agent has told me not to worry because the mistake lies with Home Office in this instance. When I phoned the HSMP line and spoke to someone, they were even surprised how the caseworker could have made that mistake as the form was correct, only that the date of 08/08 appeared on that one and only page of the Nov. 2008 version.

All it says on Page 8 of the application is the following:
"If you are producing a double-sided copy of this application form, please include this page and make sure it falls on the reverse of the payment details page in the two-sided copy.
For administrative reasons, it is important that the rest of the form begins with Section 2 - Applicant’s Details facing upwards"

The rest of the pages of the application form do not have the date 08/08 on any of the pages.

My application has been re-sent with a covering letter pointing out this error; however the application has been given a new reference number and was re-sent after April 2009. My agent has told me that since the error was made by Home Office, that they should consider the application as when it was originally sent (Feb. 2009). I have enough points to qualify but am worried that they will see the mistake but judge it under the new regulations. I don't have a Masters degree. Can someone point me in the right direction to help me speak to my caseworker so that I can deal with any problems then and there (or to even pre-raise all this information so that it can be passed to my caseworker) just in case they look at it and rule in a way that doesn't secure me an HSMP Visa? Upon reading about my situation, what does everyone think that I should do? Any thoughts or help would be much appreciated.

Before i write anything, let me put down the ECO comment:

"You have not provided the specified document to support your claim of 10 points under Appendix c of immigration rules. You have submitted bank statements from ICICI and HDFC banks, however the statements don't contain the official logo as required by the published guidance. You have not, therfore, scored 10 points under Appendix C and I refuse your application under paragraph [245C(e)] of the immigration rules"

EC applied on 2nd june and refused on 25th June, 09 in Dehli.
Now i'need some immediate help from you guys,

I've submitted the bank statements with duly sealed and signed by ICICI and HDFC bank. Offcourse the bank name and address was printed on it but not the "official LOGO" and i doubt on a Dot-Matrix printer, they (Bank)will put any paper apart from the typical computer paper (White one).

1>> Should i try for the AR? - My bank statements are genuine and i guess, if they would have tried to verify it, they would have received the positive response but they didn't verify and just rejected it on the ground of missing logo...
2>> They have explicitly stated that, I'm not supposed to send the extra documents along with my AR request. I've read on another post that someone tried to negotiate with counslate and they let him to send the extra document.
Should I try a negotiation and if they agree to it, i'll get a letter from bank stating that i've maintained at least minimum sum of this amount in my bank and the statements issued to me were genuine..
