Hi,

After re-applying the VAF1 on 29 mar 2007, i got the medical form for medical check-up.

In addition to that i will be submitting the medical documents to BHC.

Have to wait for their final decision.

Hi,

Does anybody have an idea , if and how they can check the genuinity of an IT returns.Is it possible/easy for a visa officer to check that.And if they do that, how often do they do it.

From the documents you have submitted with your application i am not satisfied that you have scored enough points. My estimation of your points is as follows :

master degree = 35
salary earnings = 25
age = 10

Total = 70

In addition i note that you have a spouse and child who do not intend travlling to uk with you and therefore not satisfied that you intend to make the uk your main home because i am not satisfied that you have scored sufficient points i am not satisfied that false representations were not made and that all materials facts were disclosed for the purpose of obtaining your immigration employment document.


I have gone thru the information from this thread and found that lot of information was there that suits my case.

case background:
The EC officer calculated the income earned from previous earnings as the IT returns of previous year (IT returns of year 2005 - 2006 ; Assessment year 2006 - 2007) . He/she misinterpreted the earnings calcuation and given me 25 poitns for earnings. But i am already eligible for the earnigns of 40 points. (Then how will i get the HSMP approval letter if the points as mentioned in the REFUSAL FORM is 70).

Not sure why the EC officer refused my application.

I HAVE AN IMPORTANT QUESTION HERE PLS...

Did this happen because you submitted HSMP file again during EC or atleast substantial HSMP documents during EC, cause for case of a friend of mine and my brother in Delhi, they wre not compelled and they did not themslevs submit HSMP file (documents send for approval) again during EC... i.e in Delhi ...
My thinking is... if they dont compel or ask for it. perhaps we shld not submit them again...
So really, did this happen to you guys cause they asked for the documents and reavaluated them, or did they try to make sense from the Proforma itself and hence reached a wrong conculusion.

Why does the EC officer have to reevaluate your file all over again. This does not make sense to me. Is this ECO in Delhi? because I hope it doesn't happen when you get to the UK and have to turn around on the next flight.

Is there a real chance of getting a decision reversal or its a mere eyewash ? (Since they may not be comfortable acknowledging there mistake and hence ask one to re-apply ).

Hi Guys

MY EC is rejected for the following two reasons can some one in this thread help me out.

1. Your account show large recent deposits, which are not consistent with your account history,you have not satisfactorly explained the reason. Also you have shown affidavit from your father states that he has gifted 3,00,00 to support you in UK, but you are failed to submit sale dee and an enumbrance certificate for this.

2. I have also considered your job offer letter, however as a result of checks made by this office i am not satisfied on a balance of probabilities, that this document is genuine, or that the company concerned is a genuine trading entity with its own bank account conataning sufficent fudns for the payment of salaries to staff and so on.


From my side

For the first case i submitted the notaried sala deed ( I assumed trhis is enough).

For the second case i have got the offer letter ( which is genuine) but i don't know abt the compnay's ficnancial statisstics ( I have no control on this), simply i accepted the offer and submitted along with the EC application.

So can guys hemp me out how to proceed fruther do u want me to reapply or appeal against my decission?.

(1) Can you please give us the timelines for your application (including Integra checks)/ the VFS you applied at etc.

(2) The large chunk of amount that was transferred recently - does it match with the gift pledge i.e INR 30000? - Were there any other large transations besides the INR 300000 amount which has been gifted to you by your father?

(3) Which notarised sale deed are you talking about?

(4) Did you submit a financial support letter from your father? Was the affidavit on a stamp paper?

(5) Did you submit his bank statements?

(6) The firm that you got the appointment letter from - are they a big name?

(7) Did you check up with the firm regarding any reference checks that BHC supposedly carried out ? - seems to be a very strange case !!

( 8 ) Have you got your original HSMP approval letter back? or have they retained it?

Here my answers to your questions.

Ans. Applied at VFS on 22-June
No idea when they contacted my employer

(2) The large chunk of amount that was transferred recently - does it match with the gift pledge i.e INR 30000? - Were there any other large transations besides the INR 300000 amount which has been gifted to you by your father?

Ans. In the last Feb-2007 i deposited 6,00,000 in cash into my A/C on my own (this is my own sisters money they are in US for some urgent requirement they gave dollors to their friend in US, after some time his father paid me back in cash in indian rupees same thing i deposited in my account to transfer it to my native place).

(3) Which notarised sale deed are you talking about?

Ans. Sale deed (nothing but sale aggrement of land)

(4) Did you submit a financial support letter from your father? Was the affidavit on a stamp paper?

Ans. Yes i submiited financial support letter and affidavit is on stamp paper

(5) Did you submit his bank statements?

Ans. No( he doe's not have that much money to show, thats why he sold the land)

(6) The firm that you got the appointment letter from - are they a big name?

Ans. No

(7) Did you check up with the firm regarding any reference checks that BHC supposedly carried out ? - seems to be a very strange case !!

Ans. Even i was wondering what the hell that firm was?

( 8 ) Have you got your original HSMP approval letter back? or have they retained it?
Ans. They have not given me back the original one nor i have the xerox copy ( do u guys have any idea how to get the xerox copy now from the BHC)

Plz do help me out in this.

How did you come to know about the rejection? Did you receive the documents through courier? Or there was some message on the VFS website (status) ?

Has BHC indicated that you are eligible for a review application?

How did you know about your rejection? Did they send all the docs and passport back to you and said rejected or they gave u back during interview?

Dear chanduambience,

Nothing to worry about the deny of your HSMP permit.
You have to Reference Number from earlier application.
Also you might be having the rejection letter from the BHC, chennai OR which VFS you applied from. It does not matter here.

Even i also got rejected from earlier application.
I made a fresh application later and got my EC and now in the uk. Also I got my HSMP permit back.

DONT GO FOR APPEAL. IT TAKES TOO LONG.

Here are a few cents from my side...

-- get a letter from your father and tell the BHC officer that your father has gifted the money to you. Also add a sales certificate.
-- The above documents shouldbe in ENGLISH.
-- Get a seal and signature from a Notarised official.
-- Attach the letter with your new application.


2. -- Not sure of the company from where you got the offer letter.
-- please double check through some source for the company if it is genuine. Check in the following site : www.companieshouse.gov.uk/
-- Try to get a letter from the employer who gave you the offer letter and explain him your difficulties. [its just a trial and error]
-- check with your friends if you can avoid keeping the offer letter.


In the main application, mention the following things:
1) Write a new application letter to teh BHC officer.
2) Explain the order of documents that you are submitting.
3) Explain the money you got from your father in simple English.
4) Explain the BHC officer about the genuineness of the company.

P.S : Experts please suggest if this should be a good approach. OR suggest some alternatives.

did they specifically mention abt the 3,00,00 deposit? was it in cash? also is it 30000 or 3lakhs? if they r making a fuss of even 30k then its a problem.

Even i was planning to get money transferred to my account to show liquid cash. current am having 70k, 80k in 2 bank accounts. other than that i can show KVP, Mutual funds and FDs to my name. also plannngto get my father's support document(Does it need to be on stamp paper) but even my father quite often does deposits in cash there. Is it a problem?

Antoby u eem to be a successful candidate. How did u show your funds break up? Can you mail me your cover letter for EC at all_go_rythms@yahoo.com?

Also is PERSONAL loan if I take is ok? say I take personal loan of 2 lakhs and show MFs KVPs etc as backup funds liquifiable.?

Kindly help me out on this. Me too planning to apply EC as soon as possibel.

I am very new to this forum and expect lot of ur help.

After getting my HSMP approval in june, i applied for EC in july and got rejection on the basis of not able to prove my 40 points which i claimed against my past earning and also got the approval. ECO was not convinced with the same proofs which i submitted TO HO for HSMP and got the approval.

So i have decided to APPEAL against the ECO decision and planning to do it on my own without any lawyer or representative. Does any body have any experience abt APPEAL or any information which would be useful for me. Since I have to file my APPEAL in 10 more days from now.....any info abt this will be very useful.........thanks in advance

Dear ganesh_deva,

I have had similar fate as yours except that in my case, ECO was not convinced that my MBA degree qualifications were original. I also filed an appeal and had to wait about 8 month before I was able to get my EC.

I would highly recommend you to either reapply or to file an appeal through an immigration lawyer in UK. I can recommend you my lawyer whom I have found quite efficient as well as quite cheap. I am not trying to advertise any lawyer just trying to help you out.

Hi all,

My HSMP has got approved. I take up this oppurtunity to thank everybody in this forum who has been helpful to me in achieving this. For the guys who have started using this forum, beleive me, this is a very informative forum.


I need to start off with my preparations for the EC. I am totally illeterate about that. Please can anyone share with us the list of documents that we need to submit for the same. Also can you please let me know abt the funds that we need to have in our bank account.

Its always advisable to go for a fresh re-application. The processing for appeal takes more than 6 months. and hence if you re-aply there are chances for your approval of EC.

I have re-applied within a week after my refusal on the grounds of not having enough points in initial application.
