Cambridge College of Learning (CCOL) never ran a Postgraduate Diploma in Business Management course or a Postgraduate Diploma in IT course. Accordingly for a person applying for leave to remain under the Tier 1 (Post-Study Work) scheme to rely on a certificate of an award of such a diploma following a course will amount to a false representation and so will fall foul of para 322(1A) of the Statement of Changes in Immigration Rules HC 395. Such a person will also be unable to meet the requirements of para 245Z because he or she could never have undertaken such a course.
very good.
ok guys
today i recieved letter from Ait after my hearing with them, appeal has been dismissed as already told to you guys.
i am posting some points from the letter.

submission made by H.O in my hearing- tribunal had stated that it considered that no person claiming to have undertaken a pgdm frm ccl can have done so without knowing that such claim amounted to a false rep.
decision and reasons- in immigration appeals the burden of proof is on the appellant(thats news to me i thought it was on H.O)
reason for refusal- the tribunal in test case have found that ccl never offered such course.the decision of the tribunal also goes so far as to say that students claiming to have studied on that course would have known that to claim to have taken such course amounted to false representation. nevertheless in this case the respondent has applied provision 322a of the immig rule which does not req that any false rep should hv been made to the applicants knowldge. so bearing in mind the findings in test case i am satisfied that the respondent was right in refusing the appellants application under para 322a.

i have been given 5days time to appeal against the above.

will keep on posting.

With every lose decision this case is losing its strength as well. I think u need to think something elso. Since home office has all the evidence.Specially test case of 3ccl students which showed ccl never offered any PG Diploma program.I dont know what to say but guys it is just wastage of time. http://www.bailii.org/uk/cases/UKIAT/2009/00031.html
when i read the whole story on above link,I think it is very clear No chance with CCL case Unless any miracle happens. Miracles do happen.

How many appeals can someone make ? I am curious because on this thread, guys just keep coming and saying 'They refused me, now I am going to appeal' from AIT ( I don't know whatever it is ), from Home Office, from High Court.

how many stages are there ?

Forget about Uk and start thinking about studying in your home country. You will be deported from the airport straigth away if you try to come Uk and that deportation stamp on your passport will aslo affect your visit to other countries of the world specially in Europe and North America

As long as you are a genuine student, attended the school full time when you were here and didn't work more than you are allowed to, you have nothing to worry about.

You can always explain to the immigration officers at the airport why did you take the break to go home and any other questions which they can ask.

I am agree with you. Don,t listen ajmal and try your luck. It is not necessary they they will check every PSW cisa back record. It is totaly upto to the immigration officer to ask you what type of question. But you must ready to answer any CCL related question and have some proof in hand.

You will get caught regardless of your port of entry as the officers have details of the visa on their computers. Colleges such as CCL have already been flagged, which means you will be interviewed at the airport and put on the next plane back to your home country. In some cases, individuals have been given a right to appeal but rest assured it will a waste of time and hard earned money.

With a right of appeal that is. He might be telling you porkies, if he says he was let in freely.

I would suggest that u keep ur movements in and out of the country a secret as there are bound to be Home office people patrolling this site..

You are not trying to enter the country illegally are you ? As I advised earlier, if you have been a genuine student, you have nothing to worry about. Choose the airport which is the cheapest and most convenient for you. Simple.
