Is ECO justified in refusing entry clearance on the basis of subsisting marriage? The documents included were content insurance, medical insurance certificate, medical card all with both partners' names on it. Only photographs were not attached which he objected.

Question: is re application a good idea, this time with photographs wedding cards etc? OR Appeal?

Re-apply if you have new evidence that will overcome the objection. Appeal if you have existing evidence that will overcome the objection.

Intervening devotion is an arbitrary concept and often, if the mindset of the ECO is that of doubt, it's best to leave the decision to a UK judge.

Leaving it to UK judge is fine but only thing is that its time consuming. 100s of photographs, wedding card, movies etc are available to include this time but no phone records. You think that would be enough this time?

Depends on the photos. Hundreds of photos of one single encounter (presumably the actual wedding party) does not show intervening devotion. A series of photos showing past and present contact over a period of time might show intervening devotion.

Also as the photographs are printed and there is no date or time stamp on them, in that case how to prove that when or where it was taken?

Different locations, clothes, hairstyles, even body mass - all of this should be obvious if they are genuine.
