Hello everyone, seems like everyone is in a mode of stress. But dont worry everything would be ok. We will win the case. Any updates regarding anyones case.
Has any one got any idea about the case, the one on the 17 th of April, If the appelants have taken the case to the next court of appeal.

can any one from this forum please let me know if any one know the following applicant..with the court of appeal Ref :20122705; Kamran & Anr v Secretary of State for the Home Department

the above case has been granted permission in court of appeal by lord justice and hearing date will be listed soon in court of appeal. His case is one of the lead case now on psw on ACCA fundamental papers and will be heard in court of appeal very soon.

and also shabnam v secretary of state for the home department.

hi,

Please let me know if anything comes on student favor. I have not been given permission for oral hearing on judicial review and i left UK on July. So if anything comes in our favour it may help me.

Hello everyone.

We should keep this forum lively or else I start thinking that every one has just left.

Can anyone here advise me on my status. I dont have my visa and it has been one and a half years now. I would like to know what should I be doing with my college as I cant just go studying there until the decision is made.

What are you guys doing these days , is everyone attending college.???

Please help

And also if anyone here knows syed personally , is there any updates.

Hi everyone,

I have been following this forum since January. I am really thankful to this forum.

I applied for PSW on ACCA last year. It's been refused and it's been in JR since then. My visa has been expired. My case dependent on Syed/Ahmed case. So, I am waiting for the answer.

I am totally confused because lack of guidance on Judicial Review on the web and my solicitor doesn't have enough knowledge.

I hope you guys can help me. I have few questions which are as follows:

1) What is my legal status if I am on Judicial review? My visa is expired.
2) Can I work for part time?
3) If Judicial review dismissed or COA rejected or they do not give the permission to go in COA, can I apply from inside UK for any other visa or I have to go back to my country and apply from there?

I am really fixed now. I don't know what to do.

Looking forward for your reply guys.

What I know about JR is
Your stay is legal until any decision is made in your case.
You can't work if you are not covered by 3c.
If you are not covered by 3c, you can't apply any in country application.

Judicial review is different from appeal. You are not covered by section 3c for judicial review so your status depends on the outcome of the review. If your review is succesful the your status while on judicial review will be legalised. If unsuccessful then the consequences of being an overstayer for that period apply.

was granted reconsideration for my psw, so HO requested for my document, submitted all, then i was refused based on maintenace on the 21th sept 2013
with right of appeal. so the question is

1.i applied for psw on the 30th of march 2012 with complete document, i had 1100 pounds as oppose to the 800 requested in my account from 8th dec 2011 till 10th march 2012, and my lawyer even stated they can count from 10th of march upwards or from 8th of dec downwards which is more than 90days requested..but on the 11th to 13th of march 2012 it has dipped by 40 quid from 800pound remaining 760.

then this is HO decision states as follow
WE HAVE ASSESED MAINTENACE FUNDS FROM THE PERIOD OF 15TH DEC 2011 TO 13 MARCH 2012 FROM THE EVIDENCE PROVIDED YOU HAVE NOT SHOWN THAT YOU MAINTAINED THE MINIMUM LEVEL OF AVAILABLE FUNDSFUNDS THROUGHOUT THIS FULL 90DAYS PERIOD AS SPECIFIED UNDER APPENDIX C OF THE IMMIGRATION RULES.THIS IS BECAUSE ON THE 12TH AND 13TH OF MARCH 2012 FUNDS FELL BELOW 800 WITH THE MINIMUM BALANCE BEEN 760 POUNDS.
NOTE, THAT ALTHOUGH YOUR REPRESENTATIVE HAS DATED THAT THEY WISHED FOR THE PERIOD TO BE ASSESED 90 DAYS BACKWARDS FROM 10MARCH 2012 ,IN LINE WITH THE IMMIGRATION RULES WE ASSESS THE MAINTEANACE PERIOD FROMTHE LAST DATE ON THE EVIDENCE PROVIDED ,PRIOR TO THE DATE OF APPLICATION AND IN THIS INSTANCE ,NO BENEFICIAL PERIOD HAS BEEN ASSESSED. SO WE THEREFORE CAN NOT AWARD YOU ANYPOINT ON MAINTENANCE FUNDS.

Hi guys,

Hope everyone is doing well. I can see the forum has really gone quiet. If you read my earlier posts on this forum you will see that I too tried to obtain the PSW visa based on the ACCA qualification. I was very confident that I would be granted as my best friend and close family friend were granted only 3 months before my application based on the ACCA qualification. Unfortunately, this was not the case as I was refused in late September 2012. I appealed the decision like most people and my appeal was allowed at the first tier tribunal but the home office appealed against that decision and since then it has been an uphill battle as the appeal was then allowed in favour of the home office.

After reading everyone's experience, I quickly realised that the home office wasn't going to budge on granting the visa based on the ACCA qualification. I had been residing with my British partner at the time but it was for less than 2 years and he was not earning the minimum income requirement for a spouse visa. We decided to get married and use the appeal system to buy us time while he negotiated a new wage with his employer. As God would have it, his employer increased his wage to £20,000/year and after 6 months of earning this new set wage I put in an application for the spouse visa and withdrew my appeal from the court of appeal. In less than 6 weeks of applying (coupled with the Christmas and new year holiday) I received my documents and brp in the post and now a week later I've been offered good job in a financial institution.

My reason for sharing my story with you guys is cause I want you all to genuinely look at other visa categories that you might fall under and try to gather the right documents to apply for the visa because the home office is keen on cutting immigration and I can't say with confidence that they would issue further PSW visas based on the ACCA qualification. It has taken me almost 2 years but I can say it was worth it. I hope everyone can find a way to make it work for them. All the best xoxo

Hello Everyone

Hope you guys are doing well.

The situation has been tough for all of us here, but we still havent given up. For anyone who is not aware of what situation we are in regards to PSW, I would like to tell you that on the 28th and 29th of January 2014 there is a very important case being heard in the Court of Appeal and that decision will benefit all of them who applied PSW based on ACCA fundamentals.

I dont know how many in total are in this situation. We are a group of around 30 people going for the hearing but I am sure there are more students out there who applied PSW based on ACCA fundamentals. For anyone who didnt know about this hearing I would like to ask them to come for the hearing on the 28th of January 2014 which is a Tuesday.

Not only the students who applied PSW based on ACCA can come, but if anyone is free that day can come as we need the court room fully packed. I will be much appreciated.The more the merrier.

Please do not hesitate to message me if anyone needs any assistance in finding about anything.

Everyone make this your first priority as it is for our betterment. I have taken a day off from work which was not easy but I managed. So everyone come on the 28th and 29th of January at 9:30 am outside Royal Court of Justice, nearest station is Holborn and from there it is around 10 mins walk.

There might be students from other parts of UK. For you guys I would personally ask if you guys can please make it.

Stay positive and the decision will be in our favour.
