YES IT IS NEXT YEAR 6 MAY 2014. AND THE WILL LAST FOR 2HOURS 30 MINS, THAT'S WHAT IS WRITTEN ON MY COURT LETTER. SORRY GUYS THERE IS WILL BE A LONG LONG WAITING FOR ALL OF YOU. If anyone required any information regarding this, please let me know.

Brother I'm not sure about your case in upper tribunal, but this is regarding all those students who their case in the high court for judicial review proceeding.

Hi Vishwen, If Khatel and others go to SC or the appeal to SC is rejected so what will be effect on the applicants whose JR is on hold due to khatel case. Vl this effect their JR or still it will proceed as yours???

Brother, sorry for the late reply, all those who sign the consent order their PERMISSION FOR JUDICIAL REVIEW WILL BE REFUSED. It just because they agreed to put their case on hold ,until khatel case decided. The court already knew khatel lost in COA, they are waiting if khatel is going to sc or not. You all need to be worried now, coz there will be a long writing.

can any one from this forum please let me know if any one know the following applicant..with the court of appeal Ref :20122705; Kamran & Anr v Secretary of State for the Home Department

the above case has been granted permission in court of appeal by lord justice and hearing date will be listed soon in court of appeal. His case is one of the lead case now on psw on ACCA fundamental papers and will be heard in court of appeal very soon.

and also shabnam v secretary of state for the home department.

Hi everyone,
Why Nobody is updating any details about the Khatel case anymore in this forum? Is everyone gone home or what??

I've applied for JR and later my solicitor signed the consent order to stay on hold until the Khatel case is decided. Khatel lost the case from Court of Appeal. Until today it seems like they haven't applied to SC.

My visa is expiring at the end of this month (31st Aug). So what will be my legal status? Is my JR still valid after signing the consent order or what?? What are the options available to me?? Please give me some suggestions.

True no updates about khatel even on zane maliks fbook there are no updates.

I am in somewhat similar situation, have been looking for some other option one of them is level 8.

can't go for entrepreneur.

so still not decided what to do.

So when your visa is expiring? I would have gone for Level 8 but I was hoping to get positive outcome from the court and didn't plan beyond that. I'm really in trouble now. Thinking to pack the luggage and book tickets to go home.

u said august 31, u still have time. You can go for level 8 and take advice from some solicitor as long as your JR is in process you will be fine.

@challenge: do you think my JR is still in progress? But according to my solicitor when Khatel lost the case from that day my JR is invalid or dismissed because of the effect of consent order.

Is there anyone who knows what will happen to JR cases after khatel lost in CA?? Is it still valid who signed the consent order or not?? How can we say it valid?? Any proof or something?? Please let me know

Have you received any thing regarding your JR?? if it was invalid they would have atleast informed you. so far i don't know anyone who has received anything about their JR.

Would like to know whats going on in Khatel case but unfortunately no updates.

No update on Khatel case as last update was Zane Malik was waiting decision for ALI's case from COA which was heard 5 week before. But one thing is sure the JR even after signing the consent order is still valid till any letter from court. Hope for the beat IA.

Letter dated 25th July
By way of an update, I understand that the appellants in SSHD V raju did not make an application for permission to appeal to the SC within the time frame for doing so. However, we have been informed that by the appellant's solicitors that the appellants are seeking funding and they expect that applications would be made early next week, with an application to extend time.
Accordingly, the defendent will update court as to whether an application has been made next week.

Later dated 17th july

I note that the consent order dated 16th may 2013 stayed these proceedings pending the COA's judgment in Khatel and others.
The COA handed down its judgement on 25th june. The respondents sough permission to appeal from the COA to the SC, however, this was refused by Lord Justice Moses.
In accordance with the terms of consent order, the parties had 21 days to agree directions for the onward progress of the present claim.
However, I note that it is open to the respondents in SSHD V Raju and others to apply to the SC for permission to appeal. Accordingly, the defendent purposes that discussion of directions be postponed until it is known whether an application for permission will be made i.e. after 23rd july. when the time for making an application expires. The parties will then seek to agree directions for the onward conduct of the present proceedings within 21 days of this date.
So, in this case do they still have time to appeal to SC?? If not surely very soon we all will receive letter from the court saying our case is over because they didn't apply for an appeal within the extended time frame. This is just my opinion. What you guys think.

By that time my visa will expire and I'll have no option rather than going home.

NEW UPDATES IN KHATEL CASE
This morning I got a letter from the treasury solicitor. It says that Khatel made the out of time application for permission to appeal in SC on 5Th of August. It also says: however these proceedings be withdrawn in light of judgement in SSHD V RAJU.

DEAR ALL,
I went to first tier tribunal on Monday 19/8/2013 for my appeal, regarding the new refusal sent but the ukba in march 2013. BUT THE PRESENTING OFFICER OF UKBA WAS NOT THERE, it was only the judge, my solicitor and me. my solicitor submit all the documents to the judge, and even told the judge, that how come my friends study with the same college, and was awarded after PSW was closed and been ranted visa, we showed all the evidence, including those who recently go visa a well, but the judge said she will give her decision within two weeks. my solicitor is confident we will win the case, as there was no CROSS EXAMINATION, I mean there was no challenge in the case. AND ALSO WE MENTIONED THAT THE CASE WAS ALREADY CHALLENGED IN THE HIGH COURT, AND THE PERMISSION FOR JUDICIAL REVIEW BEEN GRANTED. We told the judge, its all the mistakes by UKBA, and the judge was laughing. FINGERS CROSSED, THAT I WILL GETA POSITIVE DECISION.

Vish ...brother another twist in case now,ppl who won their cases in Upper Tribunal Got Letters In start of this Week,in Letters Upper Tribunal ask the Parties To attend the Case Management Review on 30th August...so there are Top Ten Firms Name who Are Representing PSW cases so Far will attend & SSHD in front of Judges..so They'll discuss the Effect of Khatel & others further cases...lets Hope it is Gud For us....& yes JR ppl also get the letters to File the Case on new Basis before 30th August.some of them already sent & they replied that Court will Put the Date of Hearing in 2months Time...means JR ppl will get the Appeal right like u...IN SHA ALLAH.....i dont know CMR will effect us & how long it gonna take...but it is gud at least that court is reviewing their decision....

Hi Rajabrave, My JR is also on hold due to Khatel and others..... but I did nt receive eny letter to file JR again on new bases. Further do any one have any news about Khatel appeal to SC??? Hope In sha ALLAH CMR will be positive.
