What dates did the applicants who were refused PSW apply for their PSW? There have been changes to the Immigration Rules post Pankina.

I have only seen unreported appeals where the PSW applicant lost on this point.

I am victim of that blog as well. I was relying on it as well. But as you know on that blog there were couple of cases in which people got PSW solely based on ACCA, they uploaded the copies of those cases as well. I think you didn't download those copies. let me know if you didn't i will send you.
And royal charter was awarded in 1974.
Hi Sinner,
Can you please send me the cases to my email address(s) email address removed by moderator

Hi Greenie, I am very much interested in your response regarding these decisions.... I'm just wondering if your opinion about fundamentals level of ACCA has changed after looking into those cases!!

I haven't seen the cases, as they are unreported and unpublished on the tribunal website.

Greenie wrote:There are a number of flaws in your argument:

1) A royal charter is a formal document granted by the monarch giving an individual or a corportate entity a right or a power. That power may be to award degrees, it may equally be used to establish a city, company or to grant a body a power to award other qualifications.

http://en.wikipedia.org/wiki/Royal_charter

http://privycouncil.independent.gov.uk/royal-charters/

Just because an organisation has been granted a power/established by a royal charter, doesn't mean they can all award degrees. For example - the constitutional basis of the BBC is the royal charter - does the BBC therefore claim it can award degrees?

http://www.bbc.co.uk/bbctrust/about/how ... agreement/

2) A recognised body is an institution granted degree awarding powers by royal charter, all such organisations are listed here:

http://www.bis.gov.uk/policies/higher-e ... sed-bodies

You will note that ACCA does not appear on this list, instead it appears on the list of listed bodies, which are institutions or bodies, which, deliver courses that lead to degrees awarded by Recognised Bodies.

http://www.bis.gov.uk/policies/higher-e ... ted-bodies

Hence, ACCA deliver a course that can lead to a degree awarded by Oxford Brookes. It cannot itself award degrees.

3) The requirement is that you have been awarded a degree at bachelors, masters or PhD level. The requirement is not that you have been awarded a qualification equivalent to a degree.

I cannot see that you can therefore argue that completing the fundamental ACCA papers alone, means that you score the points for qualification as

a) The requirement is that you have been awarded a bachelors, masters or PhD degree, PGCE, PGDE or Scottish HND
b) The qualification is none of the above
c) ACCA does not have degree awarding powers
,

Again I have to repeat the same, there are lots of students applied and got their PSW based on ACCA. The whole information was there on the ACCA forum. I am contacting ACCA to restore my forum because it helped many ACCA students who applied for the psw.

Answer to your question is the word level (para 55) it means equivalence. ACCA=Masters Degree confirmed by UK NARIC. My solicitor wrote this in his letter which he gave it to judge and he accepted that. He concluded that ACCA is a professional qualification but it is exempted from the Professional and vocational qualification denied by UKBA.

If you read my previous post you will see my response to your assertion that the answer is in the word 'level'. it is not, for the reasons I have explained. You need to have been awarded a degree not a degree level qualification, and the qualification needs to be awarded by a recognised body with degree awarding powers, which ACCA is not. Your case may have been successful but many others have not for the correct reasons, and given that the only decisions are unreported, a judge does not have to follow a decision such as yours.

Good News of ACCA Graduates!!

Post by BukhariChambers » Mon Jan 09, 2012 5:35 pm

09-01-02012
GOOD NEWS FOR ACCA GRADUATES - BUKHARI CHAMBERS
Today, the Upper-tier Tribunal at Bradford IAC heard a case of the eligibility of ACCA graduates for PSW/Tier1 as degree holding graduates. The Immigration Judges determined the case in favour of the ACCA graduate appellant who is represented by Bukhari Chambers.
This is an important case for the ACCA students awaiting confirmation that they can apply for Tier 1 (PSW) on the basis of their ACCA qualification as an equivalent to a UK Bachelors/Masters degree.
This case makes it clear that even where a formal Degree has not been granted a qualification (ACCA in this case) may still qualify for points as in the past.

Further details coming soon!

hi guys i m still not convince about PSW visa based on ACCA fundamentals. It seems really difficult case to prove it to home office and i am sure application won't be accepted in first go. If their is any room for psw visa on acca fundamentals that would be through appeal where you can argue your case.

it would be really helpful if people who had applied and got the outcome do share there experience with us.

Also i have not been able to view cases of people who have won appeal.could anyone be kind enough to send me on my email email address removed by moderator
looking forward for your replies

Can you please tell me how should I apply to NARIC? What the "purpose" should be selected for the translating or awarding?
Please help me by advising on all topics I will be grateful to you.
