Post by Jaan21 » Mon May 27, 2019 1:12 pm

I have recently moved to UK from UAE, while my kids and husband are still in UAE. my husband plans to stay in UAE. So if I now apply for children' s visa will i be granted visas ? Or will i be refused as my husband is not migrating?
I am on a teir 2 visa and maintenance marked yes on my COS.

Likely refused if your spouse is not also applying at the same time as the children. The immigration rules are clear on this point.

So if my spouse and children apply together then they should get the visa. So is it mandatory they travel together to the UK?

Yes, if the requirements are met.

No. However note that all their initial visas will be valid for 30 days only and they will all have to travel to the UK to collect their brp cards within the 30 visa validity.

Also keep in mind that the future immigration status of the children will be tied to the UK Immigration status of the less-privileged parent. So, if the other parent chooses not to migrate, the children may have issues when it comes to renewing their visas in 2.5 years time.

Can you please let me know where I can find that immigration rule?
