Hi Team,
I am in a situation where my BRP hasn't arrived almost 2 months. I was switching employers, and applied through a solicitor tier 2 visa extension sponsored by my new company. The tier 2 application was successful and received an acknowledgment letter on December 03. However the BRP has not arrived till now, the lawyer made a request to check with the BRP Team and the status is that my brp is awaiting national insurance number to be printed and hence the delay.
After resigning my last working day with my current employer was on 4th of Jan 2019, haven't received the curtailment of leave letter yet.
My joining date with my new employer was on 7th of jan 2019, but the brp hasn't arrived, the new employer is a big giant and is not ready to onboard me until the RTW is completed and hence they are going on changing the Start Date weekly awaiting until the brp arrives.
in such a scenario, where Joining date cannot be extended beyond 28days as per new rules, in my case at maximum they can change the start date until Feb 4 2018, beyond which if the brp does not arrive, they have to re-apply again with a new cos.
With hardly two weeks of time remaining until 28 days is reached, Kindly advise what best can be done just in case if the brp arrives after 28 days.( before 4th of feb 4 ).
Though my lawyer is already following up with brp team, can I also separately ask for my brp update from them. Will making multiple requests to HO about brp have an impact of anykind ?
kIndly advise what happens and what needs to be done legally if brp does not arrive within 28 days.Will the new brp which comes after 28 days will still be valid or do I have apply for new one again ?
How much time will I have to re-apply after my last working date of 4 th of Jan 2019.
