Got stuck in question when applying for sponsor licence

Post by kumar114 » Tue Jan 09, 2018 12:08 pm

Hi,
My company started filling out form for sponsor licence.
They got stuck in one question.

COS required:
Reason:

Can they put 2 instead of 1? (just in case if VISA gets rejected)
And can the reason be simply 'to employ non-EEA citizen' ?

kind regards
kumar

Thanks for the reply @aja
The company do not have sponsor licence yet.
So I was asking if they require to complete RLMT before applying for the licence? Has the rule changed?

There are 3 different actions here.

1. Sponsor applying for a Sponsorship license

2. Once the Sponsor attains sponsorship status, has the ability to Raise and Issue COS.

3. RLMT to prove, they couldn't find a Settled worker.

It is not necessary to have completed a RLMT before applying for Sponsorship.
However, the RLMT process can begin before attaining a sponsorship.
from the guidance (The vacancy must have been advertised for at least 28 days within the 6
months before you assign the CoS to a migrant.)

But, it is mandatory to have run and completed the RLMT before assigning a COS.

Could you please have a look at page 3 and 4. That is making me confused.
https://www.gov.uk/government/uploads/s ... 8_v1.0.pdf

Also on the first page, it says to provide at least 4 documents while applying for sponsor licence.
Do you have any idea what sort of documents?

Firstly, these are documents that a sponsor needs to provide to home office for attaining sponsorship status.

With respect to the type of company, it says in the relevant tables in the same link you have provided, what documents are required.

For example ; in Table 2 , for start up's less than 18 months old ,it says, the documents required are :

a certificate of VAT registration
• a letter from your corporate banking provider, setting out the
dealings it has had with you, including the nature and
duration of those dealings
• any document from Table 4 of this appendix
• a letter from the Department for International Trade (DIT) or
economic devolved government departments in Scotland,
Wales or Northern Ireland confirming that your business is
working with them; this letter can only be issued where your
company/business already has a demonstrable working
relationship with the department - see Appendix E of the
guidance for sponsors

That company is in operation for more than 3 years.
It is not a public body and it is not required to be registered with and/or
inspected/monitored by a regulatory body.

They are private business. So I do not see any relevant table.
Could you help please?

Any mix of 4 different documents from the tables should do the job.

How are you so involved with your sponsor's licence process?

Company applying for their sponsor licence/RLMT

Post by kumar114 » Sat Feb 17, 2018 2:50 pm

Hi,
Does the company has to send information regarding RLMT(things like: where it was posted, how many people applied etc) when applying for their sponsor licence?

Kind Regards
Kumar

@fielddrive
I am also helping them with the process.
Company has completed the RLMT. Time to apply for sponsor licence.
I have seen the documents required. But this is making me confused.
Should the company send these details as well while applying for sponsor licence? I thought these details are sent while issuing the COS.

Appendix A: supporting documents for sponsor licence application
If you have already identified a person, including if they are a migrant already working for you, and intend to assign a CoS to them, you should
provide the following details of the person:
• full name
• date of birth
• nationality
• current immigration status
• current job title and duties
• 3 monthly payslips, if applicable

I would advise you or your employer to read the full Tier 2 and Tier 5 Sponsor Guideline to know exactly what they need, rather than just read the appendix , all the documents needed must have been said in the main Guideline!

Hi UKLL,
Thanks. But still didn't got the answer.
Applying for a sponsor licence and assigning COS are 2 different things? Right?
So I want to know, when company applies for their sponsor licence, do they have to submit documents regarding RLMT?

kind Regards
Kumar

Hi, we did not do RMLT as we were sponsoring a degreee holder working with us which was me, we applied last week, what was the result and is there any advice you can give us as we are waiting for a PRe license visit. If u are a tier 2 or other category, my understanding is that RMlT is a must as they will send 1 cos while sending the result of your application.
