Existing Tier 2 ICT Visa extension

Hi Team,

I have ICT Tier 2 visa since 5th May 2017 to 4th May 2022 (5 years). I lived in UK from 30th May 2017 to 9th Sep 2019 (~2 years 3 months) and retuned to India on 9th Sep 2019.

After staying in India for almost 1 year 8 months I am now getting another opportunity to travel UK on 25th May 2021

I have roughly less than 1 year visa left

Can I extend my existing Tier ICT visa after new changes beyond 4th May 2022.

If it can be extended, how long can be extended?

I don't know about exact changes.

Can you please let me know whether can I extend my existing Tier 2 ICT visa beyond 4th May 2022?

You cannot hold tier 2 icy for more than 5 years unless you are a high earner. Nothing has changed.

You can switch to skilled worker visa though.

Ok. What about cooling off period?

Should I still have to leave uk on my visa expiry and have to stay my home country for 1 year to apply for new ICT or they can apply new ICT without cooling off?

There is no cooling off period anymore.

Note you CANNOT hold a tier 2 ICT visa for more than 5 years.

Skilled worker (previous tier 2 GENERAL) visa is not the same as an ICT visa.

The cooling off period use to apply to get a tier 2 general visa.

If you want to contribute on ICT and not the new skilled worker visa, then yes, you will have to leave because you cannot hold an icy visa for more than 5 years unless you are a high earner.

I was initially planned to travel on 25th May 2021 but not been able to travel.

Since I have less than 1 year visa left and since i have already stayed more than 1 year outside UK, Can my employer apply for new CoS and cancel the existing Cos so that i can stay for next 5 years?

Please let me know.
