Got the refusal mail, having 39 points. It says

Thank you for your recent application for restricted CoS. Your application has been refused, as it did not meet the minimum points score for the allocation of a restricted CoS on the above decision date.

This application will not be submitted for consideration at the next monthly allocation of restricted CoS.

You can submit another application for a restricted CoS at any time. You must ensure that your application meets the criteria outlined in the sponsor policy guidance, available from the link below, before submitting the application

Can you please help me with the below queries?
Do my employer has to raise a new COS now for March,exactly same as the one raised for February allocation?
Can he raise my salary in the new COS to gain more points next month?

Thanks

Same question here, same score but I haven't got any response yet.

If you want to raise the salary, you'll have to perform a RLMT at that salary. For the next month, the application would be exactly the same, you just have to submit again.

Thanks for your reply. Actually, in the job posting salary was 35,000-40,000, and I was offered 39,000. Is it not possible to increase it to 40,000 without a new RLMT?

For the next month, the application would be exactly the same, you just have to submit again.----- Is submitting again means creating a new COS with same details and then submit?

Regarding the salary increase and its probable impact on the RMLT/COS application , perhaps a chat with the HR would help..? In my husband's case, the HR is in close liaison with the immigration consultant and structured his salary based on whatever advise they got from the consultants.
My husband was offered a pay of 40K but the application was made for 35K... not sure if the difference between the two figures was based after deducted the allowances etc. A lot of ambiguity here and there. But the bottom line is - we are still waiting for any update from the HO from the looks of it, his application with 35 points has a slim chance :(
We are gearing up for a long weekend here and I am totally depressed not to mention frustrated!!! Nail-biting times indeed.
Prayers for all.

This process of evaluation of applications does need to evolve. Clearly its not well drawn out and am taking they should at least inform everyone of the clear defined score for every month. That takes away ambiguity and at least people are not speculting n in limbo of the unknown

Any chance of a miriacle and the 45 point applications will go through in March? That group going through will be the biggest indicator of whether anyone scoring under that will ever get approved because the back log of that group will be massive IMO.

Just share to those who are not clear like me how RCOS is being allocated
---------------- (refer to weblink removed
Which Tier 2 cases are exempt from the monthly Quota?

The RCoS scheme only applies to sponsored workers entering the UK from overseas on a “new hire” basis. The following categories of workers under Tier 2 are exempt from the RCoS arrangements:-
- Intra Company Transferees;
- Sponsored workers already in the UK under Tier 2 and applying for an extension or change of employer;
- Those who will be paid a salary in excess of a higher earner threshold (currently set at £159,600);
Individuals currently in the UK in another immigration category who are able to switch into Tier 2 (General) status from within the country (except Tier 4 (General) dependants).

How are RCoS allocated?
If demand exceeds supply, RCoS are allocated on the basis of a points scoring matrix. A higher number of points will be awarded to jobs in the following sub-categories:
- shortage occupation jobs; (refer to https://www.gov.uk/guidance/immigration ... ation-list)
- PHD level jobs;
- “new graduate” jobs or internships which meet the relevant provisions in the Immigration Rules;
- jobs which are defined as key “public service occupations”.
Jobs not in any of the above categories will be awarded points based on the salary offered, with the highest salaries achieving the greater number of points, based on salary bands. Each salary band must be approved in its entirety, meaning the number of RCoS available needs to be enough to cover the number of eligible RCoS applications within each salary band. If there are not enough RCoS available to approve the salary band, the entire band is rejected.

I agree that the 45 point back log is going to cause the most trouble. Since they carried some certificates over from January I was sure they would be able to clear the backlog of those this month but it didn’t happen.
I want to sit here and say that things will start to improve in April/May but if they didn’t this month there’s no way to predict it will improve then. April is historically a big recruitment period for nurses so there’s a really big chance it just won’t budge and the only way the back log will ever actually clear is employers pulling offers.
I can’t envision any changes to the quotas. Home Office’s hands are tied by government policy and the only thing the government is focussing on is Brexit.
Yes, I'm not so positive anymore about April/May 2018 quota rules as well. The backlog seems heavy with a chunk of 45/50+ candidates catching up each month. I also feel that everyone just re-applies so the monthly applicants is only stacking up instead of leveling-out.

Crazy knowing that each one of us commenting have secured an offer with required salaries yet struggling to make it into the system. This is obviously impacting their economy yet not hearing any conflict-resolution from HO atm.

I feel sorry for the member who quit her current job and hosted a farewell party before even receiving the RCOS. Must be a nightmare.
It has been the same situation for me. I’ve resigned from my company and serving my notice period. My employer ll be applying for COS this month. But it seems for next 2 months it won’t be possible to get the RCOS with 33 points (non shortage occupation).
from weblink removed I think your case should not be required to apply RCOS. This topic is for RCOS, not COS.

We should wait for this month's CoS allocation numbers which will be hopefully posted tomorrow on the below site.

https://www.gov.uk/government/publicati ... ponsorship

I feel the home office did not give out all of this month's quota so that some could be carried over to March which has only 1000 CoS by itself and would be slightly unfair to those applying then. That is the only way I can see the the score remaining the same even though we had 200 extra CoS this month! The only other scary thought as too why this happened is that the nurse recruitment is increasing every month instead of decreasing or remaining the same.

I have not got a response on my CoS application yet but I am sure it will be a refusal as I only had 36/45 points depending on the salary my HR put in. I was lucky enough to get a shortage occupation offer in emergency medicine on Friday. Hopefully it gets me a foot into the UK and then I get into my desired department after that.

I really hope things go back to normal in April and everyone of us gets our CoS and back to our normal lives.

Its been a pleasure getting to know everyone and their stories. See you guys in next month's thread.

Congratulations on getting your offer for emergency medicine - hopefully they will be able to get your application in by the 5th so you get your COS in March. Thanks for all your updates from your doctors group too - very informative.

I agree they may have carried some certificates over to March. Most SOC codes and salaries over 50k are in the minority and even with the mass recruitment of nurses I don’t think they could recruit and place 1000-1500 of these in one month.

@Plabber thanks for all the updates. I wish NHS recruitment in March is either low or nil if that's the case I see 45 band going through. If that happens April you can see people with lower points up to 30 getting their COS.

Also I wish if they can't increase the cap from April atleast they remove NHS from the quota and borrow some 1000 cos from next 11 months and clear the backlog and solve all these issues.

Already nobody entered UK under 50K form last few month and next month ( I hope not) so the pressure from corporate will/ must be on government to solve it.
.there is no business that can only work more than 50K they need us!! We deserve it too!

Does anyone else believe that this might be the new cut-off point (45-55) for the next 9-10 months, or possibly much longer?

Spoke to a few more lawyers yesterday and doesn't sound like April 2018 quota would be different from previous years. Net Migration is the government's goal and by introducing a larger quota number, it directly negates the purpose. :?

april will have around 2200 and we are all hoping that the backlog of nurses clears by then the cut off may still be at 36 but that is still unfair as the minimum points was 21 for almost a year now

all are thinking they should have applied earlier but this is luck and fate - let us be positive!!

Most NHS workers don’t get preference. It’s only nurses at the moment but they’re getting recruited in bulk it seems.

I wouldn’t lose hope just based on what any immigration lawyers are telling you to be honest. From my personal experience and also their predictions I’ve seen posted online they don’t know any more info that we do. It’s all speculation every month. I agree they’re not going to up the quota as the government want to cut down on migration but really anyone that’s followed any UK politics could/would assume that.

If your RLMT is still valid your employer can raise a new application for March.

I believe they can raise your salary but only within the range outlined on the job application. For example if the job advertisement said the salary range was between 40k-45k they cannot then raise your salary to 50k without re-advertising the role with that salary (they could though offer you 45k using that example as it falls within the salary range). I believe this is the case but a mod may need to confirm.
