ILR and tier 2 dependent

Post by drbalony » Sat Sep 30, 2017 9:13 pm

Hi,
I got my tier 2 visa in April 2013 but my wife and kids got theirs in December 2013.
I will qualify for irl by around March 2018 whereas my dependents should qualify by November 2018. Unfortunately their visa will expire in October 2018, short 1 month to complete 5 years stay in uk.
Can I apply for tier 2 dependent visa extension to cover this period ( before applying for ILR for them) while I am already on ILR?
Or what do you advise?
Thanks.
Seye

Thank so much.
I so somewhere in this forum that children don't need to complete 5years uk stay. Can my kids ( 6 and 5 years old) apply for ILR along with me when I have completed 5 years.

Dependents visa short of days for ILR 5 years

Post by drbalony » Sun Feb 04, 2018 8:02 pm

Hi CR001,
I need your advice.
My wife and kids arrived uk of dependent visa on 05/12/13.
ILR application should be 05/12/18- 5 years rout
Counting 28 before this day for ILR application makes it 07/11/18

2nd tier 2 extension expires on 14/10/18.
Hence short of 24 days in between.

Do I need to extend visa with a 3rd tier 2 visa or is there any other option for me?
Thanks in advance

Similar options.

Should get KoLL before, while passport is available.

Thanks vinny for the advice.

i will apply for extension before the the expiry of current tier 2 visa for my family via a registered post.

my questions are:
1. how do i then vary as soon as it is 28 days for them to make 5 yrs in uk to ILR.

2. do i need to fill a new form for ILR when i vary the application from tier 2 to ILR

3. KoLL means a pass in Life in uk test?

Thank u so much for these advice.

Hi everyone,
Thanks for this website and advice.
Still on the varying of application for my wife and kids.
i plan to apply by post for tier 2 extension on 13/10/18 (T2 expires 14/10/18)
then hopefully its not decided early and i vary the application on 07/11/18 ( 28days before 5 years date of entry 05/12/18).
the confusion now is that i spoke to Border agency customer care and she said i cannot vary until after 5/12/18 ( said 28 days before the 5 years does not count here )

any advice here.
Thanks in advance

I am currently on ILR.
my questions are :

2. is she not the main applicant now as i am no longer on tier 2 visa.
3.what CoS is she going to insert for this application

1. Online form PBS dependent partner

2. She is the main applicant yes.

3. She doesn't need a Cos if she is a dependent.

In addition, can my wife (applying by premium first) and my kids apply separately (applying by post later). all of them applying before expiry of their visas.

They should ideally apply together. HO is likely to ask about why the children are not applying if they currently hold dependent visas.

Yes you need to show maintenance for Tier 2 dependent extension - £630 for each applicant held for 90 days minimum.

Thanks so much for all your help.
The visa centre customer care keep telling me and my wife it has to be 28 days before visa expiry.

The kids and my wife are not applying together because of limited funds to show the total maintenance funds for 90 days. most of our funds go to mortgage. Hope this wont work against us.
visa expires in october 2018 and we should apply for the kids latest by last week of sept by post.

i am not sure if i can approach my current employer who provided my last CoS before i gained ILR to provide a letter of maintenance for my family. will this be acceptable?

i have put some fund into my wife account for her to show maintenance fund for herself for 90 days as she is now main applicant (as i am on ILR now)

Thanks for help

Your employer is not able to certify maintenance for your dependents once you have been granted ILR.

Quick questions about the new online application for naturalisation with ukvcas

1. Do i have to submit my passport for the entire period of application or will it b returned to me after checking at d centre

2. Is there a premium or super- premium service available

3. How long does standard application take.

Thanks
