Hi,

I would like to know if anyone has encounter the same issue as I have now.

I am on my tier 1 graduate entrepreneurs visa (second year), and my visa is due to expire.

However, I've found an A-rating company that is willing to sponsor me with a tier 2 general visa.

The main concern about this is the home office will ask about what my business which I had fail to set up and hasn't been opened.

Will it affect my application, how should I explain to them about the failure?

Will I get into trouble for not starting the business? Fraud of visa? Not fulfilling the visa requirement?

What have you been doing then s8nce you got the tier 1 ent graduate visa?

Where are the investment funds?

I've been working for the sister company of the company that is going to sponsor me with the tier 2 general visa.

I didn't needed to show funds with the graduate entrepreneurs visa.

I was to start a translation business but it didn't succeeded. I'm sure it will be one of the major issues I'll encounter if I apply for the tier 2 visa.

Just wanted to know anyone encountered the same before and what should/could I do.

You have been working in breach. Good luck with trying to switch because if they do a HMRC check you are heading for home PDQ.
