Can a employer hire under shortage list and employ them to non shortage occupation within same company ?

Sorry for this stupid question , but my employer is saying they are trying to get me through shortage list. any thought on this ?
No thats not possible according to my knowledge on this subject. Employers advertising to recruit for a “non shortage occupation job” and consequently obtaining a CoS for that role must necessarily use the CoS for an employee who is going to take up that very exact role.

If they are trying to get you through the shortage list, that means that they are changing your job profile. Please ask them in detail.
They just never tell me in details they even didn't told me what my points are. They have re-advertise the role with adding necessary work permit requirement and to me they are telling things are not good and they are trying to get me through shortage list which is very strange. i am just loosing hope here. according to me it's just 29 points.
Unfortunately employers have just been more and more vague and uncertain since december and dont give a very clear picture to their employees which only increases stress anf anxiety. As everyone ends up confused.

Dont feel disheartened. If your employer is not giving you any information, then there is not much that you can do. And what I try to implement in my life is - “when you dont have any control over something, leave it to destiny”. Dont worry. Everything will fall into plac. And if it doesnt, better things await you, im sure! :)

Approvals don't go in any order necessarily. Likely, there are batches broken up by caseworker and it depends how quickly they can get to you. They still have to verify that every application in that band is valid. If you haven't received an approval/rejection, it only means your caseworker hasn't got to you yet. It's only day two - patience people!
But this is what is scary right, that there are some caseworkers who havent even got to 50 or 55 yet. That only means that there are numerous applications above that. Which will be sad for people waiting in the 40s.
The cut off is already determined in the meeting - it's not as if going faster or slower is going to effect anyone in the 40s. The caseworkers already know what the cut off is, we're just waiting to hear.
Ofcourse the cut off is already determined, but the pace at which the caseworkers allott COS allows us to guess the number of applications at various points. If the caseworkers dont reach the 50s soon, that means that there were a lot of applications above that, which means its bad for people waiting in the 40s.

Some have already reached 50? I'm not sure that the pace of processing is any indication of what the cut off is going to be, tbh. It's been really fast some months and really slow others and the cap has stayed the same for six months.

Cant say with full certainty, for all we know the caseworkers might not even go chronologically. What can we say.

If i am not wrong, anything above 50k counts to 50 points? Please correct me if i am wrong?
50k is 46 points .. we came to know this from rcos of April month where one of our employee on 49k got rejected and one with 50 k got approval.
50k is definitely 50 points
Ok Then how would you define 46 point cut off for April month?

Its simple. No application with up to 45 points were selected. Only 50 & above were selected!

As per my understanding, though 45k to 49k slab carry 25 points as per guide.
it is like below.
46k - 26 points........
49k - 29 points
50k - 30 points
reason is if 45k to 49k is 25 points, 50 to 54 can be allotted with 26 points.why increase in 5 points??. This justifies how April cut off is 46. those with 46k salary is approved. one with 45k are rejected.

Have received certificate today, 50 points, non-SOL.
Good luck all
Quick question: Did you receive the certificate from the Home Office or through your employer?
Hi just to confirm that you are not an NHS employee. ???

I certainly feel it will help us to get COS may be in coming months. It is not clear at this stage whether they are removing nurses also from the list. If both doctors and nurses are removed things will get better surely from august. If only doctors are removed then it depends on the number of nurses recruited by the hospitals. If nurses are recruited on large numbers then it wont help us. It is still too early to predict

The link to the news-

But it is still unclear that nurses and other staff will be exempted from the visa cap or not. Dont see any huge difference even if doctors are exempted from the cap. What are your thoughts everyone?

Here is the article, it's okay to post news stories: https://www.theguardian.com/society/201 ... as-doctors

It will help if they remove all NHS codes from the cap, not sure it will help immensely if they don't remove nurses. Fingers crossed there's still a chance for it to help us this month?
The Home Office had made clear that if the rules were to change so they would operate differently in the third quarter of the year, which includes August, when newly-qualified young doctors start their NHS training, any relaxation of the policy had to be agreed by the end of this week.
Seems hopeful???

Absolutely agreed. Removing doctors alone will not be of huge help.

The article makes it clear that a changed visa policy for doctors will be implemented in the 3rd quarter of the year i.e. july august september.

To all the doctors waiting on this forum- this is a brilliant news for all of you. You should have high hopes next month. For the rest of us, pray hard everyone!

"It is unclear if nurses will also be taken out of the cap system. They are already classed as a shortage occupation by the Home Office’s migration advisory committee. As such some nurses have been deemed a greater priority than doctors in recent months when officials have been deciding who will get tier-2 visas."

Let us hope they remove nurses also. Hope for the best. That is the only thing which we can do now.
