Maternity Leave, Tax and NI

What are the rules for Tier 2 General main applicant's maternity leave? Do you get the same pay or is their deduction in pay? In case there is a difference in pay during the maternity leave period, will there be a deduction in Tax and NI? Will maternity leave have an effect while filling the ILR application?

1. The maternity pay is an issue between the tier 2 visa holder and their employer. It is not an immigration one.

2. Less pay = an adjust tax and NI per HMRC. Again, not an immigration issue.

3. No. The rules and the guidance notes are clear on the maternity period. Note however, if the person leaves the UK for maternity and is absent for 180 days or more, this will break their continuity of residence and will have an impact on ILR.
