Thanks for responding!

My employer is a a 'qualifying company' (NHS) and my job description includes 'demonstrable experience of having a lead a team'.

RLMT would NOT be needed if the SOC was SOL.-> This is confusing as my employer did RLMT to apply for RCos.

Could you please guide me to know the exact application way (SOC/non SOC) in my case?
As this is their first experience, I need to dig in to get more details around it.

Thanks,
Yojana
I don't believe the NHS is a 'qualifying company'. Qualifying company does not mean an approved sponsor by the way so you are likely not on a shortage occupation SOC under 2136. Appendix K clearly states what a qualifying company is.
4. In this Appendix “qualifying company” means a company which:
(a) has obtained permission from the Home Office to issue a Certificate of Sponsorship in respect of the relevant job on the basis that the job is included on the Shortage Occupation List and the company:
(i) is licensed as a sponsor for the purposes of Tier 2 of the Points Based System,
(ii) at the time of obtaining such permission, employs between 20 and 250 employees (inclusive), or employs fewer than 20 employees and has provided a letter from the Department for International Trade, confirming that the Department has been working with the company and supports the application in relation to its trade or investment activity,
(iii) is not more than 25% owned by a company which has one or more other establishments in the UK and one of those establishments employs more than 250 employees; and
(iv) has not been established in the UK for the purpose of supplying services exclusively to a single company or company group in the UK; and
I have verified with my employer and got to know that my employer is “qualifying company” and have applied many in SOC before. Will my case fit then in SOC SOL?

thanks,
Yojana

I think you are misunderstanding the 'qualifying company criteria'. Any sponsor can apply and issue many SOC's but not all jobs will be on the SOL. You seem to be confusing the SOC (standard occupation code) with the SOL (shortage occupation list).

NHS is not a qualifying company if you read what I have quoted form Appendix K above, particularly point (ii).

Still waiting.

senior systems engineer in an automotive company, 45k PA (not sure if this is under shortage-occupation-list). Potential employer did a RMLT anyways.
Applying for the first time; what would be my points and any possibility of clearance this month? :roll: :roll: :? :?

it is difficult to find, unless we know the job code. once we know it (obviously it is part of SOC - standard occupation code), then with the code ,job title and description u have to check if it falls under SOL SHortage Occupation List)

What do you expect in rest of 2018 ? From my research on Google, it seems May will do action soon for doctors/nurses. Does it mean more positive for everyone?

Hi,

Thank you for clearing on SOC and SOL. Its really helpful. I had a talk with my employer and they said they have applied for many codes from SOL till now.

I am just trying to find whether I can apply in Shortage Occupant because I can see the minimum points never gonna fall to 40.

Thanks,
Yojana

you mean the month may or Theresa May :) if its the latter apologies for being a bad news bearer she has already overruled the request from NHS/ Health care sector .

I expect the situation to be the same swinging between 50-55 pts each month if no policy changes made

So does that mean the decisions have been taken for all cos for the month of May? I haven't heard from my employer yet and they said my application is still on pending state. But in official site it is updated the results as on 22nd May and next meeting on 11th June. Someone please clarify

Hi all,
According to the below conventional wisdom 51 is not an option in points. Either we all misunderstand the point system or the HO is now breaking it down salary wise eg. 51 points equal 51k. Would be really interested to hear who was refused and who was accepted in the non shortage 45k to 55k salary band, and what your salary is.

TOTAL POINTS = A + B as below.
PART 1 - Type of Job: A

• Shortage occupation: 130 points
• PhD-level occupation code and job passes Residence Labor Market Test (or an exemption applies): 75 points
• Job passes Resident Labor Market Test (or an exemption applies): 20 points

PART 2 - Salary: B

• £100,000 – £155,299.99 : 60 points
• £75,000 – £99,999.99 : 55 points
• £70,000 – £74,999.99 : 50 points
• £65,000 – £69,999.99 : 45 points
• £60,000 – £64,999.99 : 40 points
• £55,000 – £59,999.99 : 35 points
• £50,000 – £54,999.99 : 30 points
• £45,000 – £49,999.99 : 25 points
• £44,000 – £44,999.99 : 24 points
• £43,000 – £43,999.99 : 23 points
• £42,000 – £42,999.99 : 22 points
• £41,000 – £41,999.99 : 21 points
• £40,000 – £40,999.99 : 20 points
• £39,000 – £39,999.99 : 19 points
• £38,000 – £38,999.99 : 18 points

50k = 46p
51k = 47p
52k = 48p
53k = 49p
54k = 50p
55k = 51p

This is how I think it works ... the range above only specifies the max points one can have for that salary range.

everyone in a salary range of 50000 54,999 is 50 points and everyone with 55k + salary till 60 k is 55 points .

Basically guys to get 51, 52,53,54 point is almost impossible this is again one of the home office elaborte way of not looking as bad on paper, but best not be fooled, the cut off salary was 55k and everyone with a salary below that was rejected

I dont want to be the bearer of bad news, but unless there is a policy change , dont see anyone below 45 going through.
I dont personally know any of you but as a well wisher Really , start looking for other countries and opportunities, dont spend your life in this constant stress, the home office and government have been aware of this situation since January and the PM herself vetoed the decision of removing the visa cap, matters have only been worse since then and the number of applicants per month have only risen.

lets face it guys the companies want us to work for them but the government thinks otherwise, sorry if I sound harsh but best of to come back to reality everyone. I spent many months on this site hoping for a miracle, following the news, writing letters to MPs in UK, signing petitions and have wasted precious months of my life . now I am trying to look for other opportunities and would recommend the same for you all with lower points

There is one more category which is milk round for graduate and post graduates from UK universities. They get 30 points. So 51 points is possible if these people get salary of 41K

like I said it is 'almost' impossible, not completely impossible and a scenario which almost most unlikely however even if some milk round candidates did scored 51 points it would be a handful not more than 2 or 3 candidates.
