Apologies for the repetitive question, but anyone else waiting gotten their rCOS? Now is the point where I have really started to worry because:

1) The rejection notice has still not come through. This leaves me with minimal time to reapply for Dec quota (cutoff date is 5th of every month).
2) If this is how much delay we faced this month, December will be much worse considering the festive season.
3) No idea what happens for Jan 2018 allocation quota numbers and onwards. Anyone with an idea on this?

Employer is actively chasing yet no revert or response from HO including call/emails despite having Tier A license.

Looking for some advice on how I can move forward and if in case it is a rejection again for me - what can I do before reapplying?

April 2016 is when UK changed their Tier 2 rules and announced a number of allocations available. Looking at this site - https://www.gov.uk/government/publicati ... april-2016 it appears as if it ends this month. What happens for Jan 2018 and onwards?

Hello, Was your still "Under Review" status ?
Yes, it's still under review I'm assuming since employer hasn't gotten back with any news and I know that they are checking the portal everyday.

I have a feeling that ours might be pushed to the December allocation and that could be a positive sign. The website also hasn't been updated. Ive noticed that most rejections are announced around 20th to 30th of the month so this could possibly a positive sign? My first application for the month of Sep was rejected on the 22'nd, similar to other people commenting here.

So let's hope for the best I guess.

Hi guys,

My employer informed me that the HO has rejected the rCOS application on Wednesday 22nd (I've applied in the Nov allocation slot).

The reason for rejection is the company's internal job advertisement, HO said that there are parts that are non compliant. However, the legal firm who's helping my employer on the application is certain we have done everything by the books.

Are we allow to appeal or would it be quicker to just reapply for the Dec allocation? Just conscious that we only have 1-2 days if we want to reapply....

Many thanks!
Appeal is a 3 month process, and my employer also applied for an appeal for the September rejection. Still haven't heard back..Better to just reapply and fix the issues from the rejected application.

For those that get rejection noticed should reapply within the day since cutoff for Dec is tomorrow. This is something I'm also anxious about.

Can anyone advise?

Total number of certificates of sponsorship available for allocation in November 1,759
Total number of certificates of sponsorship granted in November 1,747

Applications rejected and remaining rCOS carried forward - 12

This doesn't make any sense. So what's the status for applicants who haven't been given any updates?

Thanks! My employer is reapplying today for the Dec allocation. They are quite certain that we didn't make any mistakes so will just reapply using the same information. Quite anxious as I am not sure if is HO staff's oversight (which I assume a gov official might not admit) or really something to do with the job ad screenshots.

Hoping Dec process will be slightly quicker too...

I just spoke to my lawyer and she was advising to not reapply without any intimation from HO. Have you checked with your employer whether reapplying despite a pending application with no response is possible?

Hi guys,

My employer has applied for the RCOS on 1st November. Since then they told me that my application had been "Under Review". About a week ago this status changed to "Pending" and still remains unchanged.

Could any of you please advise on how long this may take, what the change means and if there is any chance of getting the visa before new years.

Cheers,

Just assuming but I think that's actually a good sign. Having an "Under Review" status would simply imply that they are reviewing your application and could possibly request for additional documents. Once that has been done, you get your approval or rejection. Considering that there has been some delays from HO lately, "Pending" status could mean that it has already been reviewed and will be addressed during December slot, even perhaps on priority?

Getting your visa, considering you submit all necessary docs, should be a 2 week process so yes maybe we could be in London before new years.

My employer has both reapplied and complain about the error to HO. Only did that cause the application was rejected and the lawyer is certain is a human error by the HO staff.

Just received an update/reply from HO, they've apologised for the oversight and also mentioned that once a decision has been made in the SMS system it can't be overturn. So urged us to reapply asap and they will treat my case outside the normal panel and grant me the RCoS.

Hi Carmen,

Thanks for letting us know about this.. This is good to know that HO has accepted their mistake. My employer also filed an appeal last week and still awaiting some response.. They are also vry certain that there were no mistakes made.. Can you let me know when was ur appeal made and how did HO contact your employer to give their response.
I can then get a fair idea when my employer will get a response and also be a little positive that Miracles do happen and HO does consider their mistak
Thanks again for your response..

My employer emailed them on the 23rd (1 day after receiving rejection) and we heard back from HO via email yesterday morning.

Our solicitor did say getting a reply/apology is very rare with HO but if you are confident that there's no mistake on your application, I am sure you will get some good news soon.

Has your employer reapply for the December allocation?

Keep us posted when you get your RCOS granted

If they agreed to issue "outside the normal panel" , then they may do it this week

Hi all,

I also have one more doubt, my job falls under shortage occupation list.. I was just reading online on HO site that jobs following under shortage occupation list doesn't need a Resident Labour market test.. But then I am not sure why my employer conducted it.. Can any one confirm my understanding. This is so that I can go back and instruct my employer accordingly
My job in under shortage occupation list and in my CoS I saw my employer mark no to the following question:
''Have you met the resident labour market test?''

So I think RLMT is not performed for jobs falling in shortage occupation list.
Hi all! :-)
It has been a while, I reviewed the messages and
I just want to share something about this...
RLMT was ticked 'yes' for my application and my job is under Shortage Occupation List .. :-)
I hope this could be of help... :)
God bless! :-)

Hi abhmahaj1,

Can you share what was the issue with salary in job advt. My job advt mentions competitive salary and I am worried it would impact RCoS application which will be filed in Jan. Iam not sure if they would reject if salary numbers are not mentioned.

I am not fully aware of the issue with salary as my employer has not revealed all the information to me.. All I know is HO didn't find the salary details appealing for others to apply for the job.. As far as I understand you definitely need to mention the salary numbers and also more details on the package and the incentives it offers.. Only competitive would be vry risky I am afraid.. Just try to put more details if that's possible now.

Hi abhmahaj1,

Can you share what was the issue with salary in job advt. My job advt mentions competitive salary and I am worried it would impact RCoS application which will be filed in Jan. Iam not sure if they would reject if salary numbers are not mentioned.

My employer has to do the re advertising again since HO mentioned issues with the salary.. So it is again starting from scratch so they haven't reapplied this month.. It is good to know that HO responded so soon.. I am hoping somthing similar with me as well.. Fingers crossed. Do keep us posted if they come back on your cos.. I am assuming you reapplied after 5th Dec??

My employer emailed them on the 23rd (1 day after receiving rejection) and we heard back from HO via email yesterday morning.

Our solicitor did say getting a reply/apology is very rare with HO but if you are confident that there's no mistake on your application, I am sure you will get some good news soon.

Has your employer reapply for the December allocation?

Hi all, my application was submitted for november - since then my application had changed from under review to pending. However, since today is new allocation date, should have my status changed and when should i expect to get a reply?

thanks!

This group has over 5,000 views now yet we're not getting as many comments/updates from people...

Anyone else who made their rCOS application for Nov but still waiting this month due to "Pending/Under Review Status" - let us know please. Whoever gets approval this week, comment asap so we can have an idea that HO has started rolling out approvals.

As per the guidelines, applicants above 21 are automatically granted rCOS but now its starting to feel like its all based on application submission timing and a bit of luck. :(
