Tier 2 Dependant !! Category closed?

Post by Shipramit » Sun Jan 10, 2021 2:38 pm

Dear Friends,

Just wondering what category I can apply in!?
My current Tier 2 dependant visa expires on February 21st.

Currently, I am working with NHS (admin work), I came to UK from India on Tier 2 dependant visa in 2018. At that time my husband was on tier 2, shortage occupation list, now my husband has job changed (still work as doctor in NHS), but he is now Citizen (through ILR 5 year route).

1. What the best option to apply next for an extension? If I apply for tier 2 extension (skilled work visa) in the application they ask for COS, which might be expired by now as my husband's job has changed and he is a citizen. Can I still use the previous COS number with shortage occupation fees?

2. Any other category I should apply to which can cost me less?
3. Does NHS staff even admin staff has an exemption for IHS (Health surcharge)?

Thanks a lot. Much appreciated

Thank you for the prompt reply.

So can I still pay the fee for the shortage occupation list job (as was the previous job of my husband)

For Heath surcharge exemption, my husband is still working with NHS as a doctor and me being a spouse is still not exempted from health surcharge?

Thank you.

Thanks a lot CR001.
Do I still pay lower fees (as I did previously as shortage occupation list job as previous COS, when he was on tier 2)

Much appreciated.

Yes.
Great thank you.
Can I just check, for applying, "the applicant" would be myself or it would be my husband.

Have they taken out the previous option of "MAIN APPLICANT" and then other applicants. It's confusing as it asks about the English language requirements?. Thank you.

The applicant is the one who is applying not the one who has ilr. So if only you are applying, then there is only one applicant.

There is no English requirment for a dependent.

Thanks a lot.

I have now applied PBS, Start up, Global talent category.
And also paid for 3 years IHS (however I would be eligible for ILR in 2 more years) as this is an extension to the previous 3 year PBS dependant visa.
Please advise me:
1. Can I request for refund of IHS if I apply for ILR after 2 years
2. If I am not exempted from IHS (as partner is now British), Can I still reimburse some IHS (as I work as admin in NHS setting as NHS staff). I saw this guidance on website.
https://www.gov.uk/government/publicati ... y-criteria.
Please clarify if I am understanding it correctly.

Thank you.

1. https://www.gov.uk/healthcare-immigrati ... on/refunds
You will not get a refund if:

your visa application is successful but you do not come to the UK
you leave the UK before your visa ends, for example to make a new application
you’re told to leave the UK before your visa expires
you’re applying for indefinite leave to remain
2. You can try, you only get 6 months back and have to apply every 6 months, if you are eligible.
