Tier 2 Dependant - Child Born In India

Hi Everyone,

I live in the UK under Tier 2 and just over a year closer to applying for ILR. My wife is on Tier 2 dependant visa . My wife travelled to India in October last year and delivered the baby at the end of Decmber 2019. I fortunately was able to travel to India and be with my wife at the time of delivery for a few days.

Now, I need to apply for a Tier 2 dependant visa for our new born baby. May you please guide me on the documents that are mandatory and the documents which are useful to submit with the application.

Mandatory Documents:
1) New Born's Passport
2) New Born's Birth Certificate
3) Copies of pages from my passport and a copy of my BRP
4) Copies of pages from my wife's passport and a copy of her BRP
5) Maintenance Fund

Supporting Documents:
1) Hospital reports from NHS and discharge summary from Indian hospital
2) Whatsapp call history for the time my wife was in India
3) Proof of transfer of money into my wife's account
4) Pictures of us three together when I was there in India at the time of delivery
5) Recommendation letters from both of our parents and copies of their ID's for prrof
6) Tenancy agreement here in the UK which includes my wife's name
7) Utility bill for additional address proof

Apart from guidance on the above lists, I would be very glad if you may provide me with answers to following questions.

a) Do I still need to show maintenance fund even if my CoS has maintenance box ticked? Is it recommended to get a letter from the company stating that they will cover the expenses for my new born baby for a month if required?

b) Do I still have to proof that our marriage is subsisting?


I would really appreciate your kind help in guiding on the lists of documents whether they are ok is there something I should submit or not submit. Further please kindly answer to those two questions above.

Yes. You must show own proof for maintenance.

Include marriage certificate and consent letter by both you and your wife for applying visa. Point 5 is not needed. Your parents letter is irrelevant here.

If possible include a letter from landlord for no objection for kids stay.

Thank you very much for taking time to respond and for your suggestion. I will get that letter from landlord sorted out.
May you kindly guide me to a link where it explicitly says that I must provide the proof of maintenance in my account by myself. My understanding from the following link is that it will be sufficient enough if I take a letter from my company (A rated sponsor) stating that they will support my child for a month if necessary. Please correct me if I am wrong.

You will not need evidence of your savings if you have a:

fully approved (‘A-rated’) sponsor
certificate of sponsorship stating that your sponsor will give each of your dependants at least £630 to cover their costs for a month if they need it

my understanding is that, your company supports first 3 months or 1month of your job.
if your applying after this period, you have to show mantainence.

I am still confused because I was able to apply for my wife's Tier 2 dependant visa first time by taking a sponsorship letter from my company. I was already on Tier 2 back then for about 2 years.
I would really appreciate someone who is up to date with the rules help me in this desperate situation of mine. I really CAN NOT afford to loose money on failed visa application.

Hi Abdul,

Did you submit visa application on your own or company is processing it through agency ?

I have similar situation and I'm submitting application on my own. however, I'm showing funds in bank to support financial maintenance.

Also, please let me know which visa application type was selected if the application is submitted by you. ?

Unfortunately I haven't started my daughter's application as I do not want to submit without knowing the consequence of showing the funds by means of sponsorship letter from my company.

I am still waiting for someone knowledgeable on this forum to confirm whether it will be fine for me to take the sponsorship letter from my A rated company to fulfil the maintenance fund needs.

Hi All,

Thank you Cr001 for the reference. It is much clearer now.

After months of delays due to Covid-19, I am about to submit the application. Just at the end of the application submission, one of the mandatory documents required is a consent letter with following point addressed.

"Letter of consent from your parent(s) or legal
guardian(s)
A letter of consent that confirms:
the relationship between you and your
parent(s)/legal guardian(s)
consent from your parent(s)/legal
guardian(s) to the application
consent from your parent(s)/legal
guardian(s) to the living arrangements in
the United Kingdom and the address
where you will be staying
whether one or both of your
parent(s)/legal guardian(s) have
responsibility for you
Both parents/legal guardians must sign the
letter of consent, except where only one
parent/legal guardian has sole responsibility
for you."


Now, the dilemma I am in is that I am currently in the UK (main PBS migrant) and my wife and daughter are in India. The instructions say that we both should sign the letter.

1) Can we both write separate letters and sign them?
2) Can we write a letter, I sign and send my wife the digital copy and she prints and sign on it again?
3) Does this letter have to be signed in front of a witness?
4) Should this letter be attested by a solicitor?
5) Is there an official format that I can use for this purpose?
