tier 2 ict - 9 years, then what?

tier 2 ict - 9 years, then what?

hello. I am currently on tier 2 ICT (since 2012) and expect to stay on it 9 years as high earner. Is there a way to stay with the same employer after 9 years without 12 months cooling off?

9 years is the max you can stay. If your aim is to apply for ILR based on 10 years long residence, you would have to find a visa that you qualify for to cover the extra time you need.

thanks, i dont care much about ILR, I care about continue working for same employer, same position. Is it possible to apply then for tier 2 general or any other way?

You will be subject to the 12 month cooling off period to change to tier 2 general.

If you have a dependent in the UK, they could get tier 2 general and you become a dependent for 12 months and then apply for your own tier 2 General after that, which you can hold for no more than 6 years.

understood, so level of salary does not matter in this case, correct?

12 month colling off is only waived if a salary in excess of £159,600pa is payable.

However, you cannot switch to tier 2 general with the same employer who sponsored your ICT visa without the cooling off periodi.e if you held a dependent visa for 12 months then no issue.

Hi, My understanding is that ICT 9 years does not require a cooling off period of one year and can get a fresh ICT immediately after expiry of old one. Can any one confirm this please? Thanks.

1. You should start your own topic with your circumstances and questions.

2. You cannot hold an ICT visa for more than 9 years continuously, as clearly stated in the rules, and only if earning more than £120k pa.

The maximum stay for each type of Tier 2 (Intra-company Transfer) visa is:

Long-term Staff (if you earn more than £120,000 a year): 9 years
Long-term Staff (if you earn less than £120,000 a year): 5 years, 1 month
