Tier 2 ICT extension

Post by Cs2021 » Thu Apr 15, 2021 9:35 pm

Hi,

Initially I came to UK in Tier 2 ICT ST on 1-Apr-2016 and stayed till 20-Mar-17. Went back to India and came back to UK in Tier 2 ICT LT on 15-Jul-17 and now my 4 years in LT visa is going to complete in 15-Jul-21. Whether I'll be eligble for one more year extension?

Whether 5 year period is calculated from start date of ST or LT visa date,

"5 years in any 6 years period" and

recent amendment (dated 7-Apr) is bit confusing.

IC 11.3. When calculating the cumulative periods of permission referred to in IC 11.1. and IC 11.2, the decision maker will include the following:
(a) all previous permission on the Intra-Company routes;

Could someone help on this.

“Intra-Company routes” means the Intra-Company Transfer route and Intra-Company Graduate Trainee route under Appendix Intra-Company routes, or the Tier 2 (Intra-Company Transfer) route under the rules in force before 1 December 2020.

To be more clearer, in 2020 (actually from 2018) believe there is no Tier 2 ICT short term. But you are saying it still counts?

I believe it does count because T2 ICT ST was part of the Tier 2 (Intra-Company Transfer) routes under the rules in force before 1 December 2020.

In more detail:
In the 6 year period 1 Apr 2016 - 1 April 2022 you are only allowed 5 years leave on ICT. You had a 1 year T2 ICT ST visa April 2016 - April 2017 and a 4 year T2 ICT LT visa 15 July 2017 - 15 July 2021, so the 5 years will be completed on 15 July 2021.
