Tier 2 ICT stay

Hi,

I first came to UK in Oct 2016 on ICT short term visa and stayed for 1 year. I went back outside UK after the short term visa expired and came again to UK in ICT long term visa in Nov 2017. It’s been 4 years in UK in tier 2 ICT now. My query is am I eligible to extend my ICT visa for 1 more year to reach the 5 years maximum stay or the time I spent in short term visa is also counted in this stay? Can someone please help me with this query?

Your time on the short time ICT visa is counted as part of the max allowable stay of 5 years on ICT assuming you are not a high earner. See Immigration Rules IC 11.2 and IC 11.3

I have just checked in the gov.uk website in the below link about the "Intra Company Transfer Visa" which states that "This visa has replaced the Tier 2 (Intra-company Transfer) Long-term Staff visa". Should Tier 2 ICT Short Term visa still be considered in the 5 out of last 6 year period?

unfortunately yes, because

“Intra-Company routes” means the Intra-Company Transfer route and Intra-Company Graduate Trainee route under Appendix Intra-Company routes, or the Tier 2 (Intra-Company Transfer) route under the rules in force before 1 December 2020.

Thanks for your reply. To be more clearer, in 2020 (actually from 2018), there is no Tier 2 ICT short term. But you are saying it still counts?
