Visa Extention-Driving w/o Ins. & Licence(Case Withdrawn)

Post by tier2ilr » Sun Jan 04, 2015 11:28 pm

Hi Guru's
&
Hi Manci.

I was stopped by Police last April on driving without licence and insurance.Matter went to Magistrate Court i submitted the mitigation statement with plead as guilty along with the situation and proofs that i have of the incident.I didn't appear in court and submitted via Post. Later Both Offences were WITHDRAWN against me in Court.
An Entry entered in The Register of Magistrate Court .

Now my question is i am about to fill the Form of visa extension as Dependent of Tier-2 Visa.

J1; Have you ever been convicted of a criminal offence either in the UK or in another
country?

My Answer is NO. As the case was withdrawn against me.

Then comes

J7; Have you ever had any civil judgements issued against you or received a civil penalty
under the UK Immigration Acts?

Do i fall under this or NOT?

J8; Please provide details of the judgement or civil penalty:

Do i need to explain the situation here?

J11; Have you ever been charged or indicted in any country with a criminal offence for which
you have not yet been tried in court?

Do you suggest me to mention this some where or in attached letter explaining what happened ? or no need to mention as case against me was withdrawn.

Your prompt reply is highly appreciated.

Best Regards

Hi buddy,

I think the answer is no for all.
- You were not charged with anything in court, case was withdrawn
- The second question is whether you have been tried for any immigration case again no
- The last is whether anything is pending judgement, again no since court case is withdrawn and you have nothing pending decision

In the future please remember to follow the rules of the country if you want to live in it... sometimes we sting a few £ here and there but when you get caught you have to pay heavy penalties.

Hi FaeLLe

Thanks for your response.

Well i agree that one has to follow the Rules of the country.which i Followed but due to some circumstantial reason case went into court where i proved my innocence. As a result of that case was withdrawn.

I have answered NO against all questions asked so not declaring the incident in the Form as well .
