hi guys,

my tier 2 is due to expire in september, which means i will have to extend soon. i have a few questions:

1. what do i need? ie do i need to request a new CoS from my employer(same employer issued my first CoS)
2. do i need to send supporting documents ie showing maintenance funds, englist test etc

your help will be appreciated

I think the rules of Tier 2 general extension before the period of visa expiry has changed.

39.18 When you assign a CoS to extend a migrant’s leave in the same tier and category, the start date on the CoS should be the day after their current leave expires.

So basically we have to wait until 3 months of visa expiry and then apply for visa extension. Is my understanding correct ?

I think no

Its been told above you can extend your visa whenever you want, you don't have to wait until your current visa expires. And few people wrote they have their visa extended early.

hello guys,

i need your help.

i am due to extend my tier 2 permit. i initially got 3 years.

i want to know how much do i pay using the premium service is it £1000 (for up to three years) or £1500 (for more than 3 years)

im confused.

My initial T2,3 year leave to remain, will expire this sept.

I will be extending, however, not sure which fees i'll have to pay, is it the up to three years one or over 3 years one?

if your initial T2 visa was under the rules after Apr 11 your total leave is capped at 6 years

This is a quick one to help me confirm what I think is right:

(a) My Tier 2 General Issued: December 2011
(b) Visa Valid till: December 2014

I am planning to apply with new COS with same sponsor and same role:

(a) COS Date of Start: August 2014
(b) COS Date of Finish: August 2017 ( 3 years)

If I submit my Application in July 2014 - will it be ok? What will happen to my BRP - will they return me the existing BRP?

1) Yes, July 2014 should be fine. You can infact, apply anytime before the expiry of your current leave.

2) You will be given a new BRP with the new dates.

Hi

I am in a similar situation in the sense that I want to apply for a visa extension on my Tier 2 visa, which will expire on 15 May 2015. I recently had a baby, and he needs to be added as a dependent. For that reason I am thinking it may be better to extent my visa now rather than adding him as a dependent now, and then pay again for him when I extent my visa next year. I would like to find out though what date should be stated as my start date on my CoS?

Although my visa only runs out in May 2015, I would like my child's visa to start asap - and be valid for 3 years. Will his (and my) visa only be valid from the new start date on the CoS?

Just to reconfirm what you had said about being able to apply for Tier 2 General Extension for 3Yrs/COS end date anytime before your visa expiry date.

Is it still valid after the recent changes to Tier 2 General rules post April-2014 ?

I am looking to extend my T2 visa
I know you told in several places that we can apply any time prior to expiry of current visa, I am arguing this point with my solicitor and he is not letting me to extend my visa, can you please provide me or let me know where can I find the information you told, so that I can prove it him

difficult to prove a negative - there is no rule that prohibits an extension application any time during the validity of a T2 visa with a new CoS. Yo

the last two lines of below contradict each other. if one can't reply before three months so how come you said "there is no restriction for early extension" pls clarify.

160. A CoS assigned by you under Tier 2 and/or Tier 5 is valid for three months from the date it was assigned. During this three month period a migrant intending to come to the UK under Tier 2 or Tier 5, or apply for worker authorisation (Croatian nationals only) cannot be assigned another CoS by any other sponsor. If the migrant does not use the CoS within this period to make an application, it automatically becomes invalid and will show as ‘expired’ on your SMS account. Please note that a migrant cannot apply for Tier 2 or Tier 5 leave more than three months in advance of the start date stated on their CoS


You are mistaken...We cannot apply more than 3 months in advance of the start date mentioned in the COS. As an example, if the start date is stated as June 15 in the COS, then we cannot apply before March 15.

But there is no restriction for early extension which has already been discussed here and clarified by Manci.

Hi,

My current Tier 2 General visa validity is until 06/01/2016. I requested my employer a new CoS now to avoid paying health surcharge that the UKBA is introducing from 06/04/2015. Unfortunately my employer refused to create a new CoS to me mentioning that they spoke with the UKBA and they advised us not to issue a new CoS now. I cannot seem to find any such rule on their website whereby they have mentioned any time based restriction on Tier 2 General visa extension.

Hi Everyone,

Could you please help me out with these question as i am bit confused and not sure what to do

you can extend your leave at any time with a new CoS but why do so if you still have 10 months leave?
Your new leave will be to the work end date stated in the CoS + 14 days or 6 years from the start date of your initial T2G visa, whichever is sooner.

Hi manci and others,

Can I ask a couple of questions - I hope they're not too dumb!

1. I am applying to renew my tier 2 visa early. I'm having a baby due 5/5/15! My husband is German citizen so baby will be registered as his dependent, and get German passport. Baby is therefore not included on my app, also not technically born yet!

I opted to remain on tier 2 visa when I got married last year to simplify process of applying for ilr. I felt switching to eea2 may complicate things unnecessarily in the future.

Current tier 2 leave expires 16 August 2015 ( this is the date on my current brp includes the 14 days at end of stay).

Received new cos today, CoS issue date is today 24/4/15, work start date is 17/8/15.
New CoS Expires on 31st Jan 2017. (I am a doctor and will need to apply for registrar jobs at that point. So my CoS extension has been granted for 18 months to cover 1 year mat leave and 6 months work as jnr doctor remaining needed to qualify for registrar jobs.)

I have booked Croydon premium service appt for 1 May 2015.( After reading this forum I understood that renewing Tier 2 earlier than 90 days before new CoS start date has been successful for a number of people). Will my tier 2 extension (if granted) run until 31 Jan 2017, or will it be shortened because I'm renewing visa early? If so, by how much?

I will be eligible for ilr via long residence route in August 2016 and intend to apply for that then so should not matter, but just wondered if I will end up cutting things very close.

Question 2: as wife of EEC citizen technically I should not have to pay the new immigration health surcharge. Has anyone had any success requesting exemption. I will ring them on Monday to clarify.

Can I just clarify though - is it ok for me to apply on 1 May 2015 using a new CoS which has an "issue date" of 24 April 2015, but which also lists the "work begins" date 17 August 2015, and "work ends "date of 31st Jan 2017??

OR do I need to reschedule appt for AFTER 17 May 2015???

Although you are the family member of an EEA national exercising treaty rights in the UK it is unlikely that the exemption applies to you as your application will not be under EEA rules. For the T2 extension your husband doesn't come into the picture at all.

Yes want early extension just to avoid hassle for visa as my company has recently started new projects in Europe so i will be travelling frequently, to obtain visa you need to have atleast 6 six valid UK visa, rather than wait for last minute i want to do a bit early extension

I will ask my employer to put work end date after 3 years on COS so hopefully i will get three years extensions and that's how i will do 5 years on tIER 2 and eligible for ILR

I will keep you all updated once i get my visa
