Student Dependent Visa Advice : Post AR Decision

Hi.. I am a Sri Lankan student in Bristol and recently completed my MSc. My wife and 2 daughters(aged 7 and 11) applied for a dependent visa last August and were refused.

I requested an Administrative Review and the AR response was to reverse the decision that was issued on January 8th, '24. It has been nearly 3 months but the original case worker is not responding.

I also produced a letter from the Doctor detailing the psychological impact of our prolonged separation on my daughters's mental health and well-being. I also approached my local MP Mrs Kerry McCarthy and her office contacted the Home Office and the only response was, "Mrs XXXXXXX’s case has been allocated to a caseworker and we will endeavour to make a decision as soon as possible. Mrs XXXXXXX will be notified if further information is required and once a decision has been made.”

1. My student visa expires at the end of May.
2. I expect to apply for a graduate visa.
3. I need to get my family in UK before at least mid-May.

Could someone kindly give me advice to expedite the process, please ?

The HO are not known to act fast when they loose.
Besides engaging with your MP, lodge a complaint.

You might have to issue a pre action protocol to force them into action.
It can be written by you but most people would go to a lawyer

There are plenty of sample letters for PAPs against the Home Office, so it is entirely possible to do it yourself. I rarely recommend the use of immigration lawyers but in this case it does give additional credibility as it is unlikely you will be able to progress to Judicial Review as an individual.
