student visa

Post by sam3113sam » Sun Dec 27, 2015 6:06 pm

hi
i would like to know if i am eligible for student extension or not below is my immigration history
entered in 25th jan 2009 student msc till april 2010, extended student for msc project work june 2010 to april 2011, psw from may 2011 to may 2013, again student mba from june 2013 to may 2015.
tried for T2 visa with my employer but licence got rejected.. applied FLR o in may15 and once rejected and applied again for FLR in october15 currently in process. would i be able to apply for student visa under professional course of cipd on HR. if so can i do it within uk.
further more if i have any other options for visa as i have lived in england for long and do not want to move to other place.
thank you
sam

Seems very unlikely. You appear have just a few months left under the 5-year study cap, plus any new course would need to be at a higher level than your previous studies, plus both your Tier 4 sponsor and the Home Office would surely look very closely at your credibility as a genuine student. Given that you say "i have lived in england for long and do not want to move to other place", they may be justified in an assumption that you are simply trying to stay in the UK.

You also appear to have been an overstayer since your first FLR(O) application was refused in October 2015. This is itself would preclude a successful Tier 4 application in the UK.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

In theory you can apply for any new visa you are eligible for, but a PBS application in the UK would be refused.

According to my analysis FLR(O) makes a dent in your immigration history as a student it appears to show that you want to stay here even if you have reached the CAP of 5 years or you are buying time.It would make your future applications more challenging in my opinion

Instead of this. exiting the country in time and then coming back on Tier 2/Spouse which would lead to settlement would be more worthwhile ,although I fully agree with you that after living so long here its hard to go back but there is nothing else you could do
