Tier 4 Application - Family in the UK

Post by businessmanuk » Thu Sep 09, 2021 2:44 pm

This is for a brother applying for student visa.

The Tier 4 application has a question, Do you have any family in the UK?

This includes:
  • immediate family - such as spouse, civil partners or children
  • grandparents or grandchildren
  • your spouse or civil partner's family
  • your child's spouse, civil partner or partner
  • your partner, if you have lived with them for 2 out of the last 3 years
Does he select Yes or No to this question as I am his brother but sibling not listed in this?

It says "This includes:" not "This means:".

Of course "any family in the UK" includes siblings.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

I thought the options mentioned under "This includes" were the only relations we could select, so I selected No.

Why would they highlight these specific relations in the section? Ugh!
Does anyone know what could possibly be done about my mistake?

I have my biometrics on Monday.

The definition of Immediate family says:

"The immediate family is a defined group of relations, used in rules or laws to determine which members of a person's family are affected by those rules. It normally includes a person's parents, siblings, spouses, children, or an individual related by blood whose close association is an equivalent of a family relationship."

Siblings are definitely our immediate family (or just family).

I believe that when you select "Yes" the next screen asks you to describe the specific relationship between you and the person, and the option "Sibling" is shown. This is the case when for example, you apply for a Visitor visa.

I do have a sibling in UK however in my application I just evaluated the options directly listed and went with a No. Thus, I wasn't transferred to the following sections for further description.

Don't know how it will affect my application.

Can we submit a cover letter for the same at the VFS appointment stating the correction made to the application?
In certain cases it is allowed? Can someone answer?
