travelling while curtailment

Post by Sunny90 » Wed Oct 19, 2022 3:55 pm

Hi

Student has passed her exam and degree certificate will be received in one or two weeks.

University has updated home office as due to course has finished early, now HO will curtail visa and update through email or letter.

Expecting letter any time onwards in next few days or week.

Student and dependent family needs to travel home country due to close family member wedding in 4 weeks which is very important.

1. What could be curtailment letter mention?

2. I understand they can not apply for graduate visa outside uk, so how can they make travelling to home country in between this time and clear immigration border when returning back?

3. applying for graduate visa now, what earliest visa approval can be expected?

1. What could be curtailment letter mention? Stating the number of days more you can stay in UK I.e. when you should exit UK failing which you become an overstayer

2. I understand they can not apply for graduate visa outside uk, so how can they make travelling to home country in between this time and clear immigration border when returning back?
Quite an high risk, if study already completed, maybe asked what is the need to have left and return back to UK?

3. applying for graduate visa now, what earliest visa approval can be expected? This can only be a guess as this is not HO platform neither do anyone work there to give such information.
IMHO, sort out the graduate visa or get a legal continuation of stay before attempting any travel.

Personally if they attend this wedding they’ll jeopardise their case, also for students best advice can be found from International student office at their own university, because they are up to date with students most recent and full history so they’ll provide you with more accurate and sometime with better information and option.

Hi

thank you for your response

is there anything that university can do about it ?

is there any way to get legal continuation of stay to make travelling happen?

all we concern about is making this wedding happen and getting back to uk, it would be really helpful to have your advise.

To continue staying in the UK beyond culmination of studies they need to switch to another visa.

They can ask the University to give a letter saying that the student will attend graduation ceremony, etc. However that's not a guarantee they will be admitted to re-enter the UK, that's absolutely up to the officer's discretion. I won't take that risk.

And to be honest, I don't think attending a wedding is an emergency case they can use to support their claims. I can understand it's an important event, but I have seen cases of students in a similar situation refraining from travelling to attend the funeral of their own parents or to see seriously ill family members.
