Today we got letter from court that home office asked for permission to appeal to the upper tribunal.
Please anyone tell us howhat easy for them to get permission.
As it's disappointment for us today.

Good Morning Elaine , Don't worry I think it is standard procedure Home Office asking for for permission to appeal

We won our appeal 4th November and then 4 days later we received a notice saying Home Office were asking for permission to appeal from first tier tribunal to upper tribunal. Then on 25th November we found out the courts refused home office permission, we are all happy for a few days till 1st December my solicitor told he received another notice this time home office were asking direct permission from the Upper Tribunal to appeal further.... We are still waiting to hear back

As far my understanding is home office have three chances to take the appeal further , Permission to appeal from the first tier tribunal to upper tribunal , permission to directly appeal to upper tribunal and then the last chance is Judicial Review however I'm not sure they always take this chance as JR is expensive and is more harder.

our decision came on 3rd Jan I am sure same date home office got it. on 5th Jan court received a request for permission to appeal.
can you please tell did they tell the court on what grounds they asking permission.?

Heyy yes when we received that their permission had been refused they stated why they appealed

All they say is that their evidence is legit and that they insist deception was involved

The judge wrote back that he agrees with the first judge decision and he doesn't agree with home office limited evidence

I don't know why they keep doing this mess even in our case we attached the report of criminal investigation officers report where they made a decision on my husband (not guilty).
I am hoping court hit back and refuse them.
your and ours appeals allowed on human rights grouds.
and they still not satisfied yet.

Hi apply permimum service in june 2016 but got refused due to toiec test with right of appeal .
Fiesr heaeing in march which judge adjourned due to lack of docs from homeoffice next set in july which also adjourned bocz homeoffice didnt serve bundle n follow direstion. 3rd set for 20 december which went theough
In heaeing homeoffice just asked few basic question which i answered .judge asked ho if she found im credible then the ho reply they will issue visa .bicz i got 2 ielts one frm back in 2004 as student was score 6.5 2nd in 2011 score 7 band.Also got degree in ba n mba.
After week got decsion that my appeal allowed that judge found me more credible witness n allowed my appeal .Now yestwrday home office asked permission for appeal in uper turbinal.
Have anyone in same situation???

Lol standard procedure of home office applying for permission when we win our appeals ,such sore losers in my opinion.

They just trying to gain a time i think . When judge clearly said front of home office if she belived im credible witness will you go for further appeal ho replied no we will show the visa. They was more focus on article 8 visa which me n my solictors said we will fight agaist the orginal decsion.
I m just anoyed because if they got permission another year in court i wil clear my self because i havnt did anything wrong .
Also i apply for vice recording they refused twise.

Oh really .
It's mean they just don't read decisions and applying for permissions to upper tribunal .
And in our case home office got decision on 3rd Jan and on 5th Jan permission request was already with court lol.
We won 2014 court against HO on toiec.
Criminal investigation team made clear report after interview with my husband.
Won again our court against HO on toiec but the not leaving us alone.

Yes we won on human rights ground also HO didn't bring any evidence on toiec so judge made very clear and solid decision but they still asking permission for appeal.

We won Ftt not upper tribunal and they asked for permission to upper court and now still waiting for court answer if they reject or accept their request and give permission.

Hi its almost same situation bocz got decsion serve on 29 dec n they apply on 5th jan to upper terbinal .
But still my czn barrister said if ftt refuesed permission to go in uper turbinals then they stil can apply direct to upper turbinals is well.
But one of my czn client he won in upper turbinal last week same toiec.Only judge asked ho where is error of law in human right appeal they Apply for new evidence permission which refused is well .

Hi Yasir your barrister is right , that's what happened to us , we won then home office appealed then their permission was refused then they appealed again now we are waiting

Timeline so far :

- Won Appeal : 2nd November

- Home office apply for permission from ftt on 4th November

- Then I would constantly call and email the tribunal to expedite my request then on 25th November home office permission was refused

- 1st of December home office appealed again this time directly to upper tribunal

Which brings us to today and I'm still waiting , now when I ring the courts they say to me waiting time at this stage takes 24 to 30 weeks

You think this toiec will ever finish ?..
Today our MP Send inquiry to home office regarding our case as last time in 2015 Mp was keep pushing them for updates then they send two officers for toiec interview and cleared my husband.

I had Toeic FTT hearing on 15th of Nov2017 and appeal was allowed on 6th of Dec. last week received a letter from post Decision Casework Team saying they are going to implement the Tribunals decision. l

Yes i rang today they said judge will make decsion to allow the permission or refused with in 8 weeks .
Its a joke another year on side lol
