We have the same situation. I have completed my 2.5 years spouse visa already with IETLS bands of 7, but I was refused on second extention due to deception was used on my tier4 visa dated back in 2013.
If you are still in the board, could you keep update your situation please.
My spouse visa application was refused in November 2017, loeged my appeal early december and got the hearing date in june 2018.

They only called interview if the test in questionable which most of them got visa if they save ielts or degress later.
My toiec test never used in any application i did only that time while waiting for ielts result and toiec n ielts both came together so i apply with ietls which score was 7 overall all n 7 in speaking is well.
But yours hubby toiec test was questionable or invalid??

My husband had an interview in November 2015 at home with voice mobile device unit.
They bring whole system with them in big suitcase.
Ok they made report after interview.
This is the report in exactly their own wording .
17/07/12 questionable test
01/08/12 invalid test
Subject remembers sitting in two tests but not the necessarily three (although he could not be 100% sure about this/. he was adamant however that he sat the test at college in London and NOT in leciester. He explained the first test he sat which he failed -and gave a good description of the correct test format. The second test format was however nothing like the test format of a genuine ETS TOIEC test. He was adamant that he had not cheated and that he had not paid for a proxy test taker to test on his behalf. He said he paid £145 in total and this was a total package and he did not pay any more money for re-test/'s. We played voice data to him and it was clear to us that the voice were different on each test with possibly the first voice matching his the most.after listening to the voices he could not be certain himself if the voice/'s were his or not.

THERE IS NO EVIDENCE TO IMPLICATE HIM IN THE FRAUD OCURING AT COLLEGE AT PRESENT.

then home office send us another decision letter and only refused us on my financial requirement.
After completing my financial requirement we applied fresh application with trinity college and they refused us again with same wording TOIEC deception.
And in last court we won on all evidence train tickets bank transactions for London travelling for test on both dates and on this investigation report result.

Good morning everyone just received an email confirming home offices permission to appeal to upper tribunal has been refused YAYYY however my solicitor is advsing we wait 16 days before chasing issuance of visa in case home office applying for JR , I'm gonna be devasted if they apply for JR

And I red many times in upper tribunal's decisions on this issue.
JR is not possible practice in Toiec ets so stay positive.

I too have read they don't usually do JRs for ETS cases but we can never be sure :(( We just have to wait it out hopefully

Hi many congrats i hope they will not gonfor JR .normilly its true they dont go for this option because its not gd pratice.
How long u get a email from upper turbinal ?
Mine ho apply on 5th january but still not heard anything yet.
Also im not sure they got my email adress so will recieved in post whtevr the finding is.

@yasir @elaine to make an expedite request simply email them customer.service@hmcts.gsi.gov.uk
In the subject part of the email write EXPEDITE REQUEST

Make sure in your email you include d.o.b , appeal number, address and full name

I sent one legnthy email to them nearly two weeks ago , they have to reply within 10 working days

Personally I think emailing is better than calling as the email gets passed on to more official people...

I am always here and reading every one's post. I won my appeal last year november and HO asked for permission to appeal same month. Unfortunately i am still waiting to hear from Judge about his/her response. I literally called the Court every friday for updates but they said no new decision has been made yet. :(

Its a really good news. Hopefully everything would be your favour. As far as i know in uk if HO loose 2 appeal out of 3 then third one will be auto win . so happy days for you. please let us know your good news.

Hi all,

Thought after all the posts about this would share what happened! We had the ftt on 3rd November. Home office went to wrong court! they said to proceed withiut them. Anyway judge was very thorough with husband he couldn’t understand motive for cheating but my husband was very nervous and didn’t come across too well. However he pretty much said there and then that we had a British child therefore will consider human rights. 3 weeks later we have confirmation that we win on human rights grounds. First week December HO applied to UT to appeal! Thought it was all over again! However, On 27th December we received amazing news that their permission was refused (their grounds made no sense!)

We finally got confirmation last week that Post
Decision unit of Home office is going to apply
Court decision.. our second baby is due in April so it’s a waiting game as to how long the BRP takes to arrive!

Any one have experience yet with how long this is going to take?

I think the toeic saga is finally winding down but home office is still making it very hard.

We received passport and documents after 2 days of BRP. After successful appeal, the visa post decision case worker issue the visa in 4-5 months.

Hi, many congratulations, I'm sure HO will not go for JR. As I had this experience and JR is expensive and time consuming.

Hi Elaine, I'm very positive that you will get the positive answer as well.
Anyone is waiting from Court of Appeals and already heard please share the experience. I'm at the final stage and can't afford to hear anything bad. Please pray for me & all.

I think you need to speak to his/her assistant and book an appointment with him/her, call their office for appointment.
Have ur solicitor letters so that you can explain the situation.

Just a letter to explain that you have exercised your appeal and it has been allowed by the Tribunal. You have to give some details of,why you want them to speedup the processing of your application.
As far as I understand they take their time. Going to MP won't make any difference.
