Hi Scott

mine was not at FTT so in JR hearing claimant are not supposed to be questioned. However, the judge did ask me one question (surprisingly) that have I studied English back home and I answered ''yes''. The JR was refused on the basis that HO has strong evidence. I have shown my two IELTS prior to TOEIC and two TOEIC test as well other than the questioned one.

Now waiting for the permission from the Court of Appeals. My concern is all appeals are allowed on the basis of humanitarian grounds but my case is not on this base. I do not know what will happen.

Some times they just give it depends on your luck as well,
I am surprised when u have done the Toeic test yourself then why they r not convinced?
How much did you pay for test registration? (Fee of the test )
Did u provide any email confirmation from Ets?

I paid £90. Regardless to provide all the information if college was under inspection they had cancel all the test have been taken in that particular college.

What is your situation? I haven't read your case.

Married to a British 2nd extention got refusal due to Toeic in past ,court hearing ahead. But won the case on JR back in 2015.
But they keep bringing it up for some reason.
I bought a property recently in London. My wife is a professional psychologist she Works for NHS.

I have provided IELTS, and trinity tests as well.
My Toeic was done and used back in 2012.

Hello, so if you won JR in 2015, then HO did challenge the UT decision. Which court your hearing will be? UT or Court of Appeals

Actually Ho cancelled their decision straight after my JR was launched in High Court and granted me a visa.
This time its my spouse visa's second extension. As they have refused my application again for the same reason so the court hearing is in FT not UT its in FEB. From HO bundle it clearly says they haven't updated their records on my files after when the toeic was dealt with.

Hi waitingindefinitely, seriously, was it refused by the Supreme Court? Apart from my tier 2 refusal, I applied in August 2017 on human rights and my application refused yesterday with ''out of Country'' right of appeal. It means HO is not acknowledging Court of Appeal decision dated 5 December 2017.

My head is spinning spent all my three years saving :( feeling so upset :cry:
Refusal letter says HO will detain or remove when I go for reporting next time. Anyone is facing the similar situation. Is anyone going to reporting to HO reporting centre on weekly or fortnightly?

Yes I'm very sure it was refused they applied for permission to appeal after those 4 successful test appeals however their permission got refused,

Ana the only way u can succeed is you can qualify for human rights/article 8

We didn't heard anything yet only got reply back from court that our expedite request is gone to next step for answer asap.
Our appeal is allowed on human rights ground article 8.

Hello Elaine we are still waiting another week to go before we can celebrate properly

They expedited my request too and then the next week we heard that home office permission got refused , I think this time next week you'll hear the same news

Hello everyone
I have seen many people from these forum succeed if they were qualify for article8, but what if I have been granted spouse visa already and my second extension was refused what might happens if I won the court and what visa should I grant after that?
I am a bit worried that they might swith me on the 10 year rout which is undesireable for me as I have been in this country for 8 years already.
Please help me xx

People accused of TOEIC cheating have in-country right of challenge


The Court of Appeal has held in Ahsan v Secretary of State for the Home Department (Rev 1) [2017] EWCA Civ 2009 that people accused of cheating on the TOEIC English language test and threatened with removal from the UK have the right to challenge that decision in this country rather than from abroad.

In three of the four grouped appeals decided this morning, the appellants had been served with a removal notice under section 10 of the Immigration and Asylum Act 1999.

The court did not accept the Secretary of State’s argument that the application for judicial review should be rejected because the appellants could pursue an in-country appeal by way of a human rights application instead.

The decision will please many people accused by the Home Office of deception on the TOEIC test and seeking to challenge that decision in-country.

In the fourth appeal, the Secretary of State had certified that an in-country appeal on human rights grounds was “clearly unfounded”, meaning that only an out-of-country option remained. This claim, too, succeeded and the certification quashed.

The court has, helpfully, given for the assistance of practitioners a short summary of its reasoning at the conclusion of a lengthy judgment, although Underhill LJ stressed that it carries a risk of over-simplification.

Court of Appeal allows lead appeals on ETS/TOEIC JRs (s10 & s94) & holds that “an out-of-country appeal would not satisfy the Appellants’ rights ... to a fair and effective procedure to challenge the decisions to remove them”

I called the court today because home offices deadline is up to apply for JR and they said to me home office didn't apply IM SO HAPPY alhamdulillah I'm just still a bit scared because solicitor said that they could have put a last minute application today and the system hasn't updated I don't know if I believe him or not however he said Monday he will call the home office to tell them to ask my husband to submit his passport , does anyone know how much more waiting there's left ?
