You don't have access and 'admin' doesn't respond to emails and nor do they 'unblock' the function. It should kick in once you have 30 GENUINE posts.

Any nonsense posts to increase your count will be deleted.

Hiya everyone . I wanted some advice or if anyone has had anything similar like my husband's case .
My husband recently went to first tier tribunal regarding the case for toiec on the 26th June 2018 . He received his decision on 16th August 2018 . He was refused on toeic basis and won appeal for article 8 (human rights). Can someone tell me if the HO will appeal for upper tribunal ? And what are the chances to win upper tribunal?

If it’s allowed only on artcle 8 then they will put yours hubby on 10 years route rather then 5 years route.
Permission of appeal to ut may granted as main allegation still valid about the toiec as in many cases they granted appeal but if its granted then again its in yours benefits because its will take the time but the end you will get the visa.

Hello everyone I want to share my timeline plz any body advise me what is next and how long. Spouse visa apply from India April 2016 Refused: may 2016. Appeal : June 2016. Court hearing :6 June 2018. decision recived : 20 June 2018 judge allowed my visa. After that I’m not heard anything

Hi if yours appeal allowed in june you should have yours visa by now.
Check with hmrc courts customer services might home office appealed against the judge decsion. If that a case then another 6 month wait.
Normilly hen judge allowed the appeal and home office don’t appeal against the ftt then you should recieved fees award in 28 days and same time you should recieved the visa is well.
Check with court first if they apply permission to appeal if not then ring home office and get update on yours visa decsion.

New Delhi British ambessey said they heven’t update about my case. After that I’m send my appeal allowed letter than they said We cannot take any further action until we receive notification from The Determinations Team that the appeal has been allowed and directing us to proceed. We speak to ukba and they saying they will be reply within 16 days. But 16 days already done.

Sounds like you need to chase up again, maybe UKBA if it’s over 16 days. If you have a solicitor can they follow up at all?

Did you manage to find out if you could get the spreadsheet? I would imagine this may not be shared as it contains many people’s information but if you did please let us know. I’ve asked Out solicitor about this too - pending response.

Well GeetL no i am still searching for an answer. I read so many appeal cases on upper tribunal website and in almost all the cases home office has provided the spreadsheet from lookup tool.

Based on the description provided in those cases
I believe the document is just about applicant test.

There are so many people who have already filed there appeals and some of them has attended the hearings as well. Guys could you please comment how the document look like and is it just about applicant?

I personally have faced this case for a long time now. I won it in FT, HO challenged it in UT and they won which I challenged and won in Court of Appeals. CoA ordered HO to reconsider the decision but I never heard from HO. God knows how long more it's gonna take to settle down.

MY Tier 2 Extension was refused in October 2016, with no right of Appeal on the basis of Toeic, Test took in 2012, although I never used the test for any extension.

Came here on Tier 4:May 2011
Took Toeic Test July 2012 (Never used in any Extension)
Extension Tier 4: Aug 2012
Tier 2 Visa: Aug 2013
Interview about Toeic: July 2015
During Video Interview
She asked following few questions
• How did you find this Course
• How did you booked
• How you paid
• How long did it take
• How many other candidates
• How you did the Preparation

(At the end She apologized for inconvenience caused to me because I never used this test in any extension and she was satisfied from my answers)
After I travelled abroad they never stop me.

Refused Extension Tier 2: Oct 2016 (Because of Toeic)
Refused Admin Review : Nov 2016
Pre action Protocol Letter sent: Dec 2016
1st Response : Dec 2016 (HO asked for an Extension)
2nd Response : Jan 2017 (HO asked for 2nd Extension )
3rd Response : Feb 2017 (HO asked Final Extension)

After final Extension deadline no response, file the JR case because only have 3 month to file the case in court after refusal date

JR Submission in Court: Feb 2017

HO reply to Court : April 2017 (HO need an extension for submitting the Defence Summary)

Court refused permission of J: Sep 2017
Applied for Oral Hearing and got Permission for JR: Dec 2017
(My solicitor requested to HO copy of the interview about toeic took place in 2015 and presented in the court at the time of oral hearing)
Home office requested to withdraw the JR application they want to reconsider the case with in 3 month: March 2018

Documents Received: August 2018.

I'm still waiting. Regarding my tier 2 refusal, Court of Appeals wrote to Home Office to send the proposal to Appellant by the 7 September 2018. Home office did not send anything to us.

Regarding my second application which was done in Aug 2017 based on human grounds will have the hearing on 13 November 2018. I'm puzzled should I go for hearing or wait HO propsal because 2nd application based on human rights will not gonna successful. I have no partner and kids so it will be hard to get on human rights basis.

In this forum, any one is waiting from HO after Hossain and Islam hearing, have heard from HO please share.

Hi Ana,
On ETS Spread sheet was showing two tests one was questionable and other was invalid, please consult with good solicitor your's case, if are you in London, please try to contact Mr Zane Malik, he is a good barrister and doing most of the Toeic cases. best of Luck
