Hi Janaghan111

i am living UK more 14 year and I have wing appeal on tire 4 in 2018 and my ILR Application was pending home office refuse my ILR application in march 2018 but they never ask me to report in centre .

Thank you for your positive response but my solicter the home office will put me on 10 year route and he want to chalange to upper tribunal I can’t understand can you please explained because I was on 5 year rounder and applied last extension which was refused by home office please help me

Do you guys have any idea what is happening with ets cases . From gld they asked us to submit relevant papers with human rights. My solicitor has submitted it last week. Dont know whats going to happen now. Anyone has faced same kind of situation pls let me know.

Dear versudev,

No they went put u on 10 year rout if you were in 5 year rout they will wait your case according to ur last pending application. Just relax brother every thing will be fine. If the home office put u on 10 year rout challenge the decision to upper tribul you have 100% winning chance.

if the GLD asked for Article 8 human right submission then the home office will reconsider your case you have 10% chances of positive response from home office and 90% chance that they will refuse your human rights application and will give you an incountry right of appeal that appeal means your visa so dont panic just keep writting me i will reply you any time but it will take a total of one year until you get your visa and compensation from home office if refused if they agree to issue your visa then up to 6 months your job will be done lets hope they dont refuse you and they just issue your visa I understand how stressful is the situation but stay cool bro you are through.

Thank u for ur response.Yes they asked me to submit . I will be completing my 10 yrs on coming 24th may. If they give me in country appeal right will i be eligible for ilr on 10 yrs nd can i apply before my hearing?

I think you should apply for ILR any time before your hearing but wait for Human rights applications out come before you go for ILR home office may give you a visa.

my one is the same type of case but I applied for ILR in 2016 and my appeal is based on that it means when I win the appeal I will get my permanent leave inshallah.

If they dont give me visa they will give me in countru appeal right, am i right? My solicitor said gld will notify about my case by end of next week. Do u ve any idea about any case time frame in this type of stage? Don't know what will happen. Im really very tensed. Pls pray for me.

dear is nothing to worry about when you win the appeal inshallah which you will as home office has no evidence to prove they are only relying on a written page that dose not explain any thing. and by the way just to tell you that judges in first tier tribunal are fed up toiec nonsence allegation I was in the court with my friend 4 months ago he even got his visa last week. so dont panic be happy this is the start I am telling you that you are OK just be happy keep yourself happy every thing will be fine. it will take time and money but once you win your case you will get all your money you paid to your lawyer please make sure you pay by card to your lawyer in order to know how much you have spent so far.

Thanx dear for ur response nd encouraging words. No ive never been into reporting center. HO never asked me to go to ny reporting center. Im really fed up now after this long battle. Yes I've always paid my solicitor via bank transfer. So wont be a problem to find out how much i ve paid.

Another 8 month for hearing!!!! Already suffering from 2016. Dont know how long they r going to stretch us...

Just rcvd a call from my solicitor office. His assistant called . He said on 28 th may my barrister nd home office barrister will have a session on court regarding my case. But my presence is not mandatory. I can be there if i want. Don't know whats going to happen. My solicitor is busy today . He will call me tomorrow. Im really frustrated.

I had a chat with my solicitor today. He said the case worker told gld that if the human right is refused then its not guaranteed that they will give me in country appeal right. Then my solicitor asked whats the remedy then. Because we all know that now a days all the toeic case r being solved via human rights application wheather visa or in country appeal right. Then the case worker said in that case go to for substantive hearing. That is on 28 may . Where my solicitor with my barrister will go. But my solicitor said he again requested with very polite way to Gld that we can sort out this matter without going to court via human rights submissions. We r not saying tgat u give me visa. Just asking pls make sure if refused then with a in country appeal right. Now see where im . And why im tensed. Its all a mess up. My human rights file is very strong not only my solicitor said this but i also checked it with another solicitor. But still dont know what will happen.

If your human rights get refused home office has to give you a right of appeal in the country so u can defend yourself. I am 100% that you will get a right of appeal. Ali has explained you every step.Ali is telling the truth i was a victim too but now i m waiting for my hearing in july.
