Hi,

We have applied for a group of artists to come and perform in UK, labour market test was carried out an advert was placed in Equity information service also at Job match. Artist application has been refused with the following commits from the ECO " You have applied as a Tier 5 group of actors`application presenting a Pothwari drama at various venues in the UK over a 1 month period and the sponsor is PM Promoters Ltd. The documents you have demonstrated in your application states the roles were advertised on Equity`s job information is not stated on the COS. Furthermore , your documents nor your COS states information regarding applications from a settled worker and the proposed out come."

As matter of fact we did mention labour market test exercise on the COS, which can be found on it, is it possible that ECO didn't go through the COS ? otherwise how could he say that "THIS INFORMATION IS NOT ON THE COS" what can be done from our end.

An early reply will be much appreciated.

Let me guess; the refusal letters had the officer initials LS?

By the way it's highly unusual to carry out an RLMT in the entertainment sector, especially where an act is concerned (rather than an individual). Usually you could be able to prove that the act is a unit company which has performed together overseas OR is of international status (fairly famous).

The visa officers (since most apps were hubbed to the UK - Sheffield mainly) always seem to refuse on the basis that the sponsor didn't carry out an RLMT (even where none is necessary). They often ignore the assurances stated on the CoS. Did the applicants provide PROOF that an advert was placed, and proof of the outcomes? Did they prove they are real actors?

The CoS often seems to count for almost nothing anymore - especially for first-time applicants. The sponsor is rarely trusted by the visa officers, so they tend to assume that any claim on the CoS is worthless unless it's backed up by physical evidence submitted in the visa applications.
