UKBA has so far failed to file the documents to the Tribunal

Appeal Lodged in August Tier 1 General

Tribunal directs to the UKBA to file the relevant documents by 31 October 2013 to the Tribunal as well as to the Appellant. Documents include notice of decision, application form, record of interview, any other unpublished documents on which they rely.

The time limit has passed and got another letter from the Tribunal says
UKBA has so far failed to file the documents relating to your case. The documents were supposed to be filed by 31 October as per The Asylum and Immigration Tribunal Rules 2005 Rule 13.

The Appeal now has been listed for a hearing on 9 July 2014. If the specified documents are not filed with the Tribunal within 10 working days before the date of this hearing, subject to rule 51(4), the appeal may be determined in the absence of this documents.

Is it normal that UKBA couldn't file the documents in time?
chances of winning the appeal?
