Uncertain of eligibility of wife as ILR dependent

Post by xpscapable » Fri Oct 19, 2012 1:24 pm

Hello

I've read the FAQ and info, but still a uncertain what the situation is for my wife.

Here's the case:

1. I'm eligible for ILR now, originally here on HSMP from July 2007 and change to Tier 1 (G) for the extensions. I'm planning to apply January next year although I've qualified July 2012 due to personal reasons.

2. My wife came to UK on working holiday visa (youth mobility) on January 2010 and converted to Tier 1 dependent from November 2011.

So technically, my wife have been living with me for over 2 years, but the first 2 years she's under her own Visa and only the past year she was here under Tier 1 (G) dependent.

Does she qualify? And if she doesn't, she has to apply for FLR(M) after I have my ILR?

What would happen in the period where I have my ILR and she's still in the old Tier 1 (G) dependent visa?

i think she is eligible for ILR as your dependent as she's been here for over 2 years.
